WOODS PUD PLANNING AND ZONING BOARD VARIANCE GRANTED RESOLUTION 95-60 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING FINDINGS OF FACT AND CONCLUSIONS REGARDING AN APPEAL FROM THE DECISION OF THE PLANNING AND ZONING BOARD APPROVING A DEVELOPMENT PROJECT KNOWN AS THE HUGH M. WOODS P.U.D. -FINAL WHEREAS, on February 27, 1995, the Planning and Zoning Board (the "Board") approved the Hugh M. Woods P.U.D. - Final (the "Project"); and WHEREAS, a timely Notice of Appeal of the Board's decision was filed with the City Clerk by Council member Gina C. Janett; and WHEREAS,-on-April-19,-1994 the City Council considered the foregoing appeal, reviewed the record on appeal and heard presentations regarding the same; and WHEREAS, at the conclusion of said hearing, the City Council upheld the decision of the Board; and WHEREAS, Section 2-56(c) of the City Code requires that, no later than the date of its next regular meeting, the City Council shall adopt, by resolution, findings of fact in support of its decision. NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Project does not meet the requirements of All Development Criterion No, A-2.3 of the Land Development GuidanceSystem(the "LD1S"),because-of the significant on- site disturbance of the topography and vegetation that will be caused by the Project. Section 2. That because the Project fails to conform to the above-referenced criterion, a variance must be granted to such criterion if the Project is to be approved by the City. Section 3. That the City Council hereby finds that, because of the on-site and off-site mitigation measures to be undertaken in connection with the Project,the plan for the Project is equal to or better than such plan would be if it conformed to the requirements of A-2.3, and a variance to said criterion would not be detrimental to the public good, nor would it impair the intent and purposes of the LDGS. Section 4. That for the foregoing reasons, the Council hereby grants a variance for the project from the requirements of the criterium no. A-2.3 of the LDGS. Section 5. That, having granted said variance, the Council hereby upholds the decision of the Planning and Zoning Board in approving the Project.
