OF THE COUNCIL OF THE CITY OF FORT COLLINS
FIXING, RATIFYING AND AFFIRMING A TELEPHONE EXCHANGE ACCESS
FACILITY CHARGE FOR THE LARIMER EMERGENCY TELEPHONE AUTHORITY
PURSUANT TO AN INTERGOVERNMENTAL AGREEMENT
DATED NOVEMBER 14, 1990
WHEREAS, the Latimer Emergency Telephone Authority was created pursuant to §29-1 1-
101, et. sQ ., C.R.S., by an Intergovernmental Agreement Concerning the Implementation of an
"E911" Emergency Telephone Service, dated November 14, 1990 between certain governmental
entities located in Latimer County, Colorado (the "E91 I Agreement"); and
WHEREAS, pursuant to the aforesaid statutory authority and City of Fort Collins Ordinance
No. 164, 1989, adopted by the City Council on April 3, 1990, the City Council may, by resolution,
raise, lower, or reestablish a telephone exchange access facility charge to be assessed telephone
service users in the City of Fort Collins; and
WHEREAS, by the terms of the aforesaid Ordinance, the City of Fort Collins approved a
telephone exchange access facility charge of fifty cents ($.50) per month effective January 1, 1991,
and said charge has remained in effect since that date; and
WHEREAS, the Latimer Emergency Telephone Authority has proposed that there by no
increase in the telephone exchange access facility charge for calendar year 1997; and
WHEREAS, the City Council deems that the continuation of a telephone exchange access
facility at the rate of fifty cents ($.50) per month is necessary and appropriate to adequately fund
emergency telephone services in the City of Fort Collins.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, as follows:
Section 1. That pursuant to §29-11-101, et. sue., C.R.S., and the E911 Agreement, the
monthly fifty-cent telephone access facility charge which originally commenced on January 1, 1991,
and which has continued through the effective date of this Resolution, is hereby ratified.
Section 2. That the telephone exchange access facility charge shall continue at the rate
of fifty cents ($.50)per month per exchange access facility until such time, if at all, that such rate
is modified by the City Council.
Section 3. That telephone service suppliers providing telephone service in the City of
Fort Collins are hereby authorized to collect the telephone exchange access facility charge, at the rate
referenced above, in accordance with to §29-11-101, et. sec., C.R.S.
Passed and adopted at a regular meeting of the City Council held this 5th day of November,
A.D. 1996.
