HomeMy WebLinkAbout1993-163-11/02/1993-ACCESS CONTROL PLAN COLORADO DEPT HIGHWAYS SOUTH COLLEGE AVENUE US HIGHWAY 287 RESOLUTION 93-163 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF FORT COLLINS AND THE STATE OF COLORADO, DEPARTMENT OF HIGHWAYS, AMENDING THAT CERTAIN ACCESS CONTROL PLAN FOR COLLEGE AVENUE/ US HIGHWAY 287 BETWEEN SWALLOW ROAD AND TRILBY ROAD WHEREAS, on December 6, 1988, the Council of the City of Fort Collins adopted Resolution 88-169(B) authorizing the City Manager to execute an intergovernmental agreement between the City and the State of Colorado Department of Highways establishing an Access Control Plan for College Avenue/US Highway 287 between Swallow Road and Trilby Road within the City limit ("South College Avenue Access Control Plan") ; and WHEREAS, on October 4, 1993, the Planning and Zoning Board of the City of Fort Collins approved the Matterhorn PUD Preliminary Plan upon the condition that (among other things) the South College Avenue Access Control Plan be amended to allow for a right-in/right-out access point approximately 250 feet north of the intersection of College Avenue and Horsetooth Road prior to final approval of the Matterhorn PUD, which amendment shall be limited in its application to the uses proposed for the Matterhorn PUD or such other uses as are determined by the City Director of Transportation and the Colorado Department of Transportation as having similar traffic characteristics to those created by the uses proposed for said development; and WHEREAS, the traffic study prepared for the Matterhorn PUD has demonstrated to the satisfaction of the City Director of Transportation that the inclusion of a right-in/right-out access point on the west side of College Avenue approximately 250 feet north of the intersection of College Avenue and Horsetooth Road, in combination with the construction of the new deceleration lane and right turn lane for southbound College Avenue to westbound Horsetooth Road, would improve the operating efficiency of the College Avenue/Horsetooth Road intersection; and WHEREAS, the City Council has accordingly determined that the South College Avenue Access Control Plan should, in the interest of public safety, be amended to authorize the aforesaid right-in/right-out access point; and WHEREAS, the City Charter, at Article II, Section 16, provides that the Council may, by ordinance or resolution, enter into contracts or cooperative or joint activities with other governmental bodies. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be, and hereby is, authorized to enter into an intergovernmental agreement between the City and the State of Colorado Department of Highways for the purpose of amending the South College Avenue Access Control Plan as approved by the City Council on December 6, 1988, by the addition of the following: A right-in/right-out access may be considered for the west side of College Avenue approximately two hundred fifty (250) feet north of Horsetooth Road. This access shall be limited in its application to the uses proposed for the Matterhorn PUD Preliminary, or such other uses as are determined by the City Director of Transportation and the Colorado Department of Transportation as having similar traffic characteristics to those created by the uses proposed for said development.
