OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT
WITH THE COLORADO DEPARTMENT OF TRANSPORTATION
FOR THE IMPLEMENTATION OF THE WETLAND MITIGATION PLAN
FOR THE HARMONY ROAD/INTERSTATE 25 TRANSPORTATION TRANSFER CENTER
WHEREAS, the City and the Colorado Department of Transportation(CDOT)have worked
together to establish the Harmony/Interstate 25 Transportation Transfer Center(the "TTC"); and
WHEREAS, the TTC will benefit the City and its citizens by improving the safety and
efficiency of the Harmony Road and Interstate 25 interchange and surrounding area; and
WHEREAS, the development of the Harmony Interchange will disturb certain wetlands in
the vicinity of the site; and
WHEREAS, in the vicinity of the TTC, the City owns Arapaho Bend Natural Area, which
natural area contains existing wetlands that CDOT has proposed to enlarge for the purpose of
mitigating the impacts of the disturbance of wetlands; and
WHEREAS, CDOT has worked cooperatively with City staff to prepare a Wetland
Mitigation Plan for the purpose of mitigating the disturbance of wetlands for the construction of the
TTC; and
WHEREAS, CDOT and City staff have negotiated a proposed intergovernmental agreement
setting out the respective rights and responsibilities of CDOT and the City in connection with said
Wetland Mitigation Plan; and
WHEREAS, City staff has recommended to the City Council that the Wetland Mitigation
Plan proposed by CDOT be approved and accepted by the City and that the IGA implementing said
plan be executed between the City and CDOT; and
WHEREAS,the proposed IGA further requires CDOT to create and successfully establish
1,400 square meters of wetland, in accordance with U.S. Army Corps of Engineers requirements;
and
WHEREAS, the proposed IGA requires that the City maintain the wetlands established by
CDOT in perpetuity, or, if necessary in the future, repair or replace such wetlands; and
WHEREAS, the Council of the City of Fort Collins has determined that the IGA for the
implementation of the Wetland Mitigation Plan as a part of the Transportation Transfer Center
project is in the best interest of the citizens of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS,that the Mayor be,and hereby is,authorized to execute the Intergovernmental Agreement
with the Colorado Department of Transportation for the implementation of the Wetland Mitigation
Plan, provided that the City Manager, in consultation with the City Attorney, may negotiate such
additional terms and conditions as he deems necessary in the best interest of the City, prior to the
execution of said Intergovernmental Agreement.
