OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE CITY OF FORT COLLINS SALES POLICY FOR
PROPERTY ACQUIRED THROUGH OR IN LIEU OF
SPECIAL ASSESSMENT FORECLOSURE PROCESSES
WHEREAS, on May 19, 1992, the Council of the City of Fort Collins (the
"Council ") adopted Resolution 92-91 establishing the City of Fort Collins Sales
Policy for Property Acquired through or in Lieu of Special Assessment Lien
Foreclosure Process (the "Sales Policy") ; and
WHEREAS, the Sales Policy has been applied by City staff in marketing
special assessment property; and
WHEREAS, members of the Council Finance Committee reviewed the Sales Policy
in light of the City's experience and determined that an amendment to the Sales
Policy would be appropriate; and
WHEREAS, the Council considers it to be in the best interests of the City
to amend the Sales Policy.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Sales Policy be amended by the addition of the following language:
Any offer to purchase property governed by this policy which includes a
contingency based on the approval of land use by the City of Fort Collins
Planning and Zoning Board will be rejected and not considered for approval
until such time as said contingency is removed from the contract.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 5th day of October, A.D. 1993.
