OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN
AGREEMENT TO EXTEND THE EXISTING LEASE
OF THE ROCKWELL RANCH
WHEREAS, the City of Fort Collins and the City of Greeley ("the Cities")
are the owners of certain real property known as the Rockwell Ranch ("the
Ranch") ; and
WHEREAS, the Cities, through their Trustee, Charles Bishopp, have leased
the Ranch to Virlon G. Parker and Jesse C. Greer ("the Lessees") since 1972; and
WHEREAS, it is desirable to extend the existing lease for an additional one
(1) year term, with a subsequent automatic extension for one (1) additional year,
and the present Lessees have offered to continue the lease arrangement for such
additional term upon substantially the same terms and conditions as. contained in
the original lease, as previously extended; and
WHEREAS, the Ranch was originally acquired by the Cities for use as part
of their water systems, but the Ranch is not used now as part of the City of Fort
Collins' water system; and
WHEREAS, Section 23-114 of the Code of the City of Fort Collins authorizes
City Council to lease, for a definite term of two (2) years or less, any and all
interest in real property owned in the name of the City, provided the City first
finds, by resolution, that the lease is in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
1. That the continued leasing of the Ranch to the Lessees is in the best
interests of the City.
2. That the Mayor be, and hereby is, authorized to execute an agreement
with the Lessees extending and modifying the terms of the existing lease of the
Ranch for an additional one (1) year term, with a subsequent automatic extension
for one (1) additional year.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 16th day of March, A.D. 1993.
