OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO CONTRACTS
WITH THE UNION PACIFIC AND BURLINGTON NORTHERN RAILROADS
FOR UNDERPASSES FOR THE POUDRE TRAIL NEAR
NORTH COLLEGE AVENUE
WHEREAS, the North College Avenue bridge over the Poudre River is scheduled
to be replaced in the near future by the State Highway Department; and
WHEREAS, the replacement of the North College Avenue bridge over the Poudre
River will provide the City with the opportunity to connect the Poudre River
Trail to Lee Martinez Park and Old Fort Collins Heritage Park through the
construction of underpasses under the new bridge and under certain railroad
tracks situated in the immediate area of the bridge, in the approximate locations
shown on Exhibit A, attached hereto and incorporated herein by this reference;
and
WHEREAS, the Union Pacific and Burlington Northern Railroads own or have
an easement or right-of-way interest in the real property on which the railroad
tracks are located; and
WHEREAS, in order to construct underpasses under the Union Pacific and
Burlington Northern Railroad tracks for the Poudre River Trail , the City must
enter into contracts with the railroads for the construction of these
underpasses; and
WHEREAS, it is in the best interest of the City to enter into these
agreements for construction of the underpasses in order to connect the Poudre
. River Trail with Lee Martinez Park and the Old Fort Collins Heritage Park.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the City Manager is hereby authorized to enter into an agreement with the
Union Pacific Railroad and an agreement with the Burlington Northern Railroad,
on behalf of the City of Fort Collins, to allow the City to construct underpasses
of the Union Pacific Railroad and Burlington Northern Railroad tracks located
near the North College Avenue bridge over the Poudre Trail for a total cost not
to exceed $3,350.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 7th day of December, A.D. 1993.
