OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO AMEND AN EXISTING AGREEMENT
WITH THE STATE BOARD OF AGRICULTURE TO INCREASE
THE WATER AND SEWER SERVICE FEES FOR COLORADO STATE
UNIVERSITY AND DIRECTING THE CITY MANAGER
TO GIVE NOTICE TO COLORADO STATE UNIVERSITY OF
TERMINATION OF THE AGREEMENT
WHEREAS, water and sanitary sewer service is furnished to the State Board
of Agriculture for the use and benefit of Colorado State University under a 1974
Agreement ("the Agreement"), which should be amended to reflect increased rates;
and
WHEREAS, the City Council has determined that the reasonable charge to be
made to the State Board of Agriculture for water service is $1.17 per 1000
gallons and for sewer service is $1.31 per 1000 gallons; and
WHEREAS, the Council considers it to be in the best interests of the City
to approve an addendum to the Agreement which provides that the City shall
furnish water and sanitary sewer service to Colorado State University at such
rates, effective July 1, 1993, until June 30, 1994; and
WHEREAS, the Council also wishes to terminate the Agreement effective June
30, 1994, by directing the City Manager to give notice of termination to Colorado
State University as permitted under the Agreement.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the terms and conditions of the above-referenced addendum
be, and the same hereby are, accepted and approved.
Section 2. That the Mayor be, and hereby is, authorized to execute said
addendum for and on behalf of the City of Fort Collins.
Section 3. That the City Manager be, and hereby is, directed to give
Colorado State University notice of termination of the 1974 Agreement by giving
such notice one year prior to June 30, 1994, as required by the 1974 Agreement.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 15th day of June, A.D. , 1993.
