HomeMy WebLinkAbout1993-085-06/15/1993-DARE DRUG ABUSE RESISTANCE IGA POUDRE SCHOOL DISTRICT R-1 RESOLUTION 93-85 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE POUDRE SCHOOL DISTRICT R-1 PERTAINING TO THE DRUG ABUSE RESISTANCE EDUCATION PROGRAM WHEREAS, the City of Fort Collins ("the City") provides law enforcement services within the City, and the Poudre School District R-1 ("the District") administers the public elementary, junior high and high schools within the City; and WHEREAS, the Drug Abuse Resistance Education ("D.A.R.E.") program is a prevention curriculum which is developed by educators and designed to be taught by uniformed police officers; and WHEREAS, the Council of the City believes that the D.A.R.E. program provides an effective means for educating students about the dangers of substance abuse and promoting abstinence from the use of illegal drugs, thereby serving a public purpose of substantial benefit to the City; and WHEREAS, the City and the District are committed to working cooperatively to provide school -age children of the City with the knowledge, attitude and skills necessary to resist pressures to experiment with drugs and alcohol ; and WHEREAS, Article II, Section 16, of the Charter of the City and Section 29- 1-203, C.R.S. , authorizes the City to collaborate with other governmental entities to cooperatively provide functions or services lawfully authorized to each. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be, and hereby is, authorized to enter into an intergovernmental agreement with the District to provide for cooperation between the City and the District in offering the D.A.R.E. curriculum in participating elementary schools of the District, which agreement shall be substantially in the form shown on Exhibit "A," attached hereto and incorporated herein by this reference. THIS AGREEMENT, dated this ��Jtl� day of June , 1993 , is by and between the CITY OF FORT COLLINS, COLORADO, a municipal corporation (hereinafter referred to as "the City") , and POUDRE SCHOOL DISTRICT R-1, a body corporate (hereinafter referred to as "Poudre R111) . W I T N E S S E T H WHEREAS, the City provides law enforcement services within the City of Fort Collins; and WHEREAS, Poudre R1 provides education and administers elementary, junior high and schools within the City of Fort Collins; and WHEREAS, Project D.A.R.E. (Drug Abuse Resistance Education) is a prevention curriculum developed by educators and taught by uniformed police officers; and WHEREAS, by this Agreement, the parties wish to establish their mutual commitment to provide the children of the City with the knowledge, attitudes and skills necessary to resist the pressures to experiment with drugs and alcohol; and WHEREAS, Section 29-1-203 , C.R.S. , authorizes governments to enter into cooperative agreements with one another to provide any function, service or facility lawfully authorized to each of the contracting units. NOW, THEREFORE, in consideration of the mutual promises herein below contained and other good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the parties agree to be legally bound as follows: 1. Project Description. Project D.A.R.E. is an educational curriculum aimed at preventing drug and alcohol abuse through the presentation of classroom sessions which provide information and develop decision- making skills in connection with the subjects of tobacco, alcohol, drugs and peer pressure. 2 . Project Participation. For each school year, the actual number of elementary schools and classes which will participate in this project shall be determined by mutual agreement. 3 . City Commitment. The City agrees that its Police Services will assign trained and qualified police officer(s) to teach the D.A.R.E. curriculum in the participating Poudre R1 elementary schools. The City will be responsible for preparing the D.A.R.E. curriculum and submitting the same to Poudre R1 for review and approval on or before August 1 of each calendar year during the term of this Agreement. 4 . Poudre R1 Commitment. a. Poudre R1 shall review the D.A.R.E. curriculum submitted by the City and notify the City within twenty (20) calendar days of its receipt thereof as to whether the curriculum is acceptable. Upon approval of the curriculum, Poudre R1 agrees to provide classroom time and coordinate scheduling for the City's officers to present this curriculum in participating elementary schools. Poudre R1 also agrees to encourage teachers in participating classes to support and reinforce the curriculum through supplementary classroom activities. b. The parties acknowledge that, in previous years, Poudre R1 has been successful in obtaining federal funding to pay for the cost of all materials used in the presentation of the curriculum. During the term of this Agreement, Poudre R1 agrees to make timely application for additional federal grants for such purpose for each school year. In the event that Poudre Rl is unable to obtain such funding in any particular year, it shall so notify the City, in which event the City and Poudre R1 will thereafter jointly seek to identify other funding sources for curriculum materials, including without limitation, other state or federal grants, community donations and any other City or Poudre R1 funds which may lawfully be made available for this purpose. 5. Term and Termination. This Agreement shall be effective as of the date first- above written and shall continue in effect indefinitely. Any party to this Agreement may terminate its involvement at any time after serving fifteen (15) days written notice upon the other party. 2 6. Applicable Laws. At all times during the term hereof, the parties hereto shall adhere to all applicable federal, state and municipal laws, rules, regulations and ordinances. 7 . Relationship of Parties. The parties enter into this Agreement as separate, independent governmental entities and shall maintain such status throughout. 8. No Assignment. Each party covenants and agrees that it will not assign this Agreement or any interest therein or part thereof or any right or privilege pertinent thereto without the prior written consent of all other parties first having been obtained. 9 . Entire Agreement. This Agreement embodies the entire agreement of the parties. The parties shall not be bound by or be liable for any statement, representation, promise, inducement or understanding of any kind or nature not set forth herein. No changes, amendments or modifications of any of the terms or conditions of this Agreement shall be valid unless reduced to writing and signed by all parties. 10. Applicable Law. Severabilitv. The laws of the State of Colorado shall be applied in the interpretation, execution and enforcement of this Agreement. Any provision rendered null and void by operation of law shall not invalidate the remainder of this Agreement to the extent that this Agreement is capable of execution.
