OF THE COUNCIL OF THE CITY OF FORT COLLINS
REPLACING THE CITY'S APPOINTED DIRECTOR ON THE
PLATTE RIVER POWER AUTHORITY BOARD OF DIRECTORS
WHEREAS, the Platte River Power Authority ("the PRPA") was created by an
agreement between the cities of Fort Collins, Loveland, Longmont and the Town of
Estes Park, (the "Organic Contract, " which was amended and restated as of March
31, 1980) ; and
WHEREAS, under the Organic Contract, the PRPA Board of Directors is
comprised of two members from each of the four member cities, with one such
member to be the Mayor of each municipality (or another member of the
municipality's governing body designated by the Mayor) and the other to be
another individual selected by the municipality's governing body for "judgment,
experience and expertise which makes (him/her) particularly qualified to serve
as the Director of an electric utility"; and
WHEREAS, the City of Fort Collins has historically appointed the City's
Utility Director to fill the appointed position on the PRPA Board; and
WHEREAS, on December 15, 1992, the City Council adopted Resolution 92-191,
appointing Richard H. Shannon, Utility Services Director, to a four-year term on
the PRPA Board of Directors as the City's appointed director; and
WHEREAS, the Organic Contract states that "any director appointed by the
governing board of a municipality may be removed at any time by such governing
board with or without cause"; and
WHEREAS, the City Council believes that its appointed member of the PRPA
Board should be a member of the City Council .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that Richard H. Shannon is hereby removed as the City's appointed representative
to the PRPA Board of Directors and that Bob Winokur is hereby appointed to fill
the vacancy created by such removal and to serve as the City' appointed
representative on the PRPA Board until December 31, 1996, or until such
appointment is changed by the City Council , whichever first occurs.
Passed and adopted at a regular meeting of the Counc f the Cit of Fort
Collins held this 1st day of June, A.D. 1993. /
