OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE PURCHASE OF APPROXIMATELY EIGHTY
ACRES OF LAND FOR NATURAL AREA PURPOSES
WHEREAS, Elizabeth Herring and Cameron Thomas Herring are the owners of
approximately 80 acres of land located west of Overland Trail Road and adjacent to the City's
existing Pineridge Natural Area in Fort Collins, more particularly described on Exhibit "A," attached
hereto and incorporated herein by this reference and referred to herein as "the Property"; and
WHEREAS, Elizabeth Herring and Cameron Thomas Herring have agreed to sell the
Property to the City for the amount of$8,000 per acre, or approximately $640,000; and
WHEREAS, one of the objectives of the Natural Areas Policy Plan as adopted by the City
Council is to establish a system of publicly owned natural areas to protect the integrity of critical
conservation sites, protect corridors between natural areas, preserve outstanding examples of Fort
Collins' diverse natural heritage and provide a broad range of opportunities for educational,
interpretive, and recreational programs to meet community needs; and
WHEREAS,the Parks and Recreation Master Plan as adopted by the City Council delineates
an open space corridor along the Foothills west of the City which includes the Property; and
WHEREAS,the City Structure Plan delineates a rural/open land edge west of the City which
includes the Property; and
WHEREAS, the purchase of the Property will help the City meet the objectives of the City's
Natural Areas Policy Plan, Parks and Recreation Master Plan, and Structure Plan; and
WHEREAS, in the November 1992 General Election, the citizens of the City of Fort Collins
approved a one-quarter cent sales tax for the purpose of acquisition and maintenance of natural areas;
and
WHEREAS, sufficient funds are available and appropriated in the Natural Areas Project in
the Capital Projects Fund for the acquisition of said Property, and additional funds are available in
the Capital Projects Fund for maintenance of the Property following acquisition; and
WHEREAS, the Council has determined that the purchase price of said property is fair and
reasonable and in the best interests of the citizens of the City; and
WHEREAS,the Natural Resources Advisory Board and the Parks and Recreation Board have
recommended to the Council that the acquisition of the Property be completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Manager and Mayor be, and hereby are, authorized to execute such
documents as are necessary for the City to acquire the Property comprising approximately eighty(80)
acres of land, as described on Exhibit "A," for$8,000 per acre.
Section 2. That the eighty (80) acres of land, while owned by the City, shall be used solely
as a public natural area, and that in the event that the City Council subsequently determines that it
is in the best interests of the City to sell or otherwise dispose of all or any portion of the Property,
the proceeds of such sale shall be dedicated to the acquisition or maintenance of other public natural
areas.

A tract of land situate in the Southeast 1/4 of Section 20 and a tract of land situate in the Northeast
1/4 of Section 29, Township 7 North, Range 69 West of the 6th P.M., Larimer County, Colorado
which considering the East line of the Northeast 1/4 of said Section 29 as bearing S 00' 39' 38" W
and with all bearings contained herein relative thereto and more particularly described as follows:
Tract"A": A tract of land situate int he Southeast 1/4 of Section 20, Township 7 North, Range 69
West of the 6th P.M.,Larimer County, Colorado which is contained within the boundary lines which
begin at the Southeast corner of said Section 20 and run thence S 88' 49' 24" W 30.00 feet along the
South line of the said Southeast 1/4; thence along the boundary of the Dixon Creek Substation, N
000 12' S5" E 369.01 feet and again S 880 49' 24" W 360.00 feet and again S 00' 12' S5" W 40.00
feet and again S 88' 49' 24" W 105.00 feet and again S 00' 12' S5" W 329.00 feet to a point on the
South line of the said South 1/4; thence S 88' 49' 24" W 1228.22 feet along the said South line;
thence N 06' 27' 38" E 205.25 feet; thence N 89' 59' 24" E 166.06 feet; thence N 00' 37' 24" E
1097.53 feet to a point on the Southerly line of County Road 42-C; thence along said Southerly line,
N 780 24' 24" E 426.12 feet to a point on the North line of the South 1/2 of the said Southeast 1/4;
thence N 87' 57' 00" E 1110.29 feet along the said North line to the Northeast corner of the South
1/2 of the said Southeast 1/4; thence S 00' 12' 55" W 1391.40 feet along the East line of the said
Southeast 1/4 to the point of beginning, containing 45.1286 acres more or less and being subject to
a right-of-way for Overland Trail over the East 30.00 feet there of and to power line easements
described in Book 914 at Page 317 and at Reception No. 93051045 of the Latimer County Records.
Tract `B": A tract of land situate in the Northeast 1/4 of Section 29, Township 7 North, Range 69
West of the 6th P.M.,Latimer County,Colorado, which is contained within the boundary lines which
begin at the Northeast corner of said Section 29 and run thence S 00' 39' 38" W 1003.75 feet along
the East line of the Southeast 1/4 to a point on the Northerly line of Skimmerhorn Street; thence
along the said Northerly line, S 77' 23' 47" W 139.842 feet and again along the are of a 267.00 foot
radius curve to the left a distance of 151.82 feet, the long chord of which bears S 61' 06' 26" W
149.78 feet to a point on the North line of Burns Ranch at Quail Ridge Subdivision, First Filing;
thence along the said North line, S 88' 27' 14"W 898.32 feet and again S 87' 16, 51" W 280.09 feet;
thence N 12' 32' 24" W 599.81 feet; thence N 14' 32' 24" W 540.50 feet to a point on the North line
of the said Northeast 1/4; thence N 88' 49' 24" E 1228.22 feet along the said North line to a point
