OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING ACCEPTANCE OF A DONATION OF APPROXIMATELY
FORTY-ONE ACRES OF LAND FOR NATURAL AREA PURPOSES
WHEREAS, Rob Udall is the owner of approximately 41 acres of land located west of
Overland Trail Road and adjacent to the City's existing Campaeau/Reservoir Ridge Natural Area
in Fort Collins,more particularly described on Exhibit "A," attached hereto and incorporated herein
by this reference and referred to herein as "the Property"; and
WHEREAS, Rob Udall has offered to donate the Property to the City for incorporation into
the City's system of public natural areas; and
WHEREAS, Rob Udall and the City of Fort Collins have entered into an Agreement to
Donate Land; and
WHEREAS, one of the objectives of the Natural Areas Policy Plan as adopted by the City
Council is to establish a system of publicly owned natural areas to protect the integrity of critical
conservation sites, protect corridors between natural areas, preserve outstanding examples of Fort
Collins' diverse natural heritage and provide a broad range of opportunities for educational,
interpretive, and recreational programs to meet community needs; and
WHEREAS,the Parks and Recreation Master Plan as adopted by the City Council delineates
an open space corridor along the Foothills west of the City which includes the Property; and
WHEREAS,the City Structure Plan delineates a rural/open land edge west of the City which
includes the Property; and
WHEREAS, acceptance of the donated Property will help the City meet the objectives of the
City's Natural Areas Policy Plan, Parks and Recreation Master Plan, and Structure Plan; and
WHEREAS, in the November 1992 General Election, the citizens of the City of Fort Collins
approved a one-quarter cent sales tax for the purpose of acquisition and maintenance of natural areas;
and
WHEREAS,sufficient funds are available in the Natural Areas Project of the Capital Projects
Fund for maintenance of the Property following acquisition; and
WHEREAS, the Council has determined that acceptance of said Property is in the best
interests of the citizens of the City; and
WHEREAS,the Natural Resources Advisory Board and the Parks and Recreation Board have
recommended to the Council that the Property donation be accepted.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Manager and Mayor be, and hereby are, authorized to execute such
documents as are necessary for the City to accept the donation of the Property comprising
approximately forty-one (41) acres of land, as described on Exhibit "A".
Section 2. That the forty-one (41) acres of land shall be used solely as a public natural area.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this
1 st day of October A.D. 1996.

A tract of land situate in the West ''/2 of the Southeast 1/4 of Section 31, Township 8 North, Range
69 West of the Sixth P.M., Latimer County, Colorado, which considering the South line of the said
Southeast 1/4 as bearing West and with all bearings contained herein relative thereto is contained
within the boundary lines which begin at the South 1/4 corner of said Section 31, and run thence N
00024'30" W 812.48 feet along the West line of the said Southeast 1/4 to a point on the top of a
ridge; thence along said ridge line N 3731'05" E 292.28 feet and again N 65°26'30" East 129.72
feet, and again N 40°57'45" E 134.66 feet and again N 49°32'25" E 813.39 feet, and again N
21°54'40" E 175.54 feet, and again N 36°08'40" E 136.60 feet, and again S 67°39'15" E 36.13 feet,
and again N 55°07'55" E 146.64 feet to a point on the East line of the West 1/2 of the Southeast 1/4,
thence S 00°08'34" E 1,320.97 feet along the said East line, thence S 89°51'26" W 375 feet, thence
S 00008'34" E 270.00 feet,thence N 8905 F26" E 375.00 feet to a point on the East line of the West
1/2 of the said Southeast 1/4, thence S 00°08'34" E 480.00 feet to the Southeast corner of the West
1/2 of the said Southeast 1/4 , thence West 1,302.32 feet to the point of beginning,containing 41.0186
acres more or less and being subject to all easements and rights-of-way in place or now of record.
