HomeMy WebLinkAbout1997-112-08/05/1997-CITY FUNDS EXPENDITURE PERSONAL PROPERTY DAMAGED REMOVAL DISPOSAL SPRING CREEK FLOOD RESOLUTION 97-1 l2 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE EXPENDITURE OF CITY FUNDS FOR THE REMOVAL AND DISPOSAL OF PERSONAL PROPERTY DAMAGED DURING THE SPRING CREEK FLOOD WHEREAS, on July 28 and 29, 1997, certain areas of the City were severely damaged and five (5) lives were lost due to the flooding of Spring Creek; and WHEREAS,the flood destroyed or severely damaged numerous mobile homes and vehicles located in the Johnson Center Mobile Home Park and the South College Trailer Park; severely damaged public and private infrastructure; caused the evacuation of residences and businesses; caused the temporary closure of businesses; and caused the loss or destruction of various items of personal property; and WHEREAS, numerous mobile homes, motor vehicles, trailers, furniture, appliances and other items of personal property were destroyed during the course of the flood, some of which have already been removed by City crews during emergency operations related to the flood; and WHEREAS, other such items of personal property remain in areas affected by the flood and are situated upon privately owned property; and WHEREAS, the City has adopted the Uniform Code for the Abatement of Dangerous Buildings, 1976 Edition, (the "Code")which establishes a process for requiring the removal of any buildings or structures which have been so severely damaged as to constitute a"dangerous building" which endangers the life, health, property or safety of the public or the occupants of said building or structure; and WHEREAS,the process established under the Code is time consuming, and the removal of a building or structure under the provisions thereof would be at the expense of the owner of such building or structure; and WHEREAS,the expeditious removal of any such items of personal property which are not salvageable is in the best interests of the City so as to minimize the health and safety hazards presented by the continuing presence of such property in areas accessible by citizens of the City, and such expeditious removal would serve an important public purpose,justifying the expenditures of public funds therefor; and WHEREAS,the City Manager has heretofore extended an offer to the owners of such items of personal property an offer to have the same removed and demolished by the City at City expense, provided that all owners and lien holders of such property consent to such removal; and WHEREAS, the City Council wishes to ratify and approve such offer of City assistance. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, as follows: Section 1. That Council hereby finds that the above-described program for the removal and disposal of items of personal property destroyed or severely damaged by the Spring Creek flood serves an important public purpose for the citizens of the City and is in the best interests of the City. Section 2. That, subject to the appropriation of the necessary funds therefor, the expenditure of such funds for the above-described program is hereby approved by the City Council upon such terms and conditions as the City Manager may deem necessary and desirable to protect the health, safety and welfare of the citizens of the City. Section 3. Nothing herein shall be construed as limiting the City's ability to abate a public nuisance according to the provisions of the Uniform Code for the Abatement of Dangerous Buildings or other relevant provisions of the City Code or as otherwise permitted by law.
