OF THE COUNCIL OF THE CITY OF FORT COLLINS
SUPPORTING SB 96-1 REGARDING
REINSTATEMENT OF THE"NOBLE BILL"
WHEREAS,transportation funding is one of the highest priorities for Colorado; and
WHEREAS, there are extensive unfunded transportation needs in Colorado totaling a
minimum of$14 billion for state and local transportation projects and programs over the next 20
years; and
WHEREAS,SB 96-1 would reinstate the"Noble Bill"which was law in Colorado from 1979
to 1988; and
WHEREAS, SB 96-1 provides for funding state and local transportation needs by allocating
a portion of currently collected state sales and use taxes to the Highway Users Tax Fund (HUTF);
and
WHEREAS, the amount to be allocated per year to the HUTF for state and local
transportation needs will be phased in over four years,is estimated to total$170 million in FY 2000-
01 when the phase-in period is completed, and will be equivalent to the estimated amount of state
sales and use taxes attributable to the sales of motor vehicles and motor vehicle-related accessories
such as batteries, oil and tires; and
WHEREAS, the revenues would be shared under the 60% state, 22% counties, and 18%
municipalities allocation formula; and
WHEREAS,SB 96-1 provides for the allocation of net revenue from state sales and use taxes
to the HUTF and,therefore,the limitation on general fund appropriations does not apply; and
WHEREAS, SB 96-1 is proposed to be approved by the Colorado General Assembly as a
statutory amendment which would be referred to a statewide vote of the people of Colorado.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT COLLINS, COLORADO as follows:
Section 1. The City Council of the City of Fort Collins supports the approval of SB 96-1
concerning the allocation of state sales and use tax revenues from the sale of motor vehicles and
motor vehicle-related accessories to the HUTF for state and local transportation needs.
Section 2. The City Council of the City of Fort Collins only supports SB 96-1 with the
inclusion of the 60% state, 22% counties, and 18%municipalities allocation formula.
Section 3. The City Council of the City of Fort Collins strongly recommends that SB 96-1
funds be flexible in order to be used for regional transportation priorities including multi-modal
transportation needs as sanctioned in the Statewide Transportation Plan, and recently approved by
the Colorado Transportation Commission.
