OF THE COUNCIL OF THE CITY OF FORT COLLINS
MAKING FINDINGS OF FACT AND CONCLUSIONS REGARDING
THE APPEAL OF A DECISION OF THE BUILDING REVIEW BOARD
RELATING TO THE WILLOW SPRINGS NORTH P.U.D. APARTMENT COMMUNITY
WHEREAS, on September 25, 1997,the Building Review Board (the `Board") approved a
variance to the City's accessibility standards for the proposed multi-unit housing project known as
Willow Springs North P.U.D. Apartment Community (the "Project"); and
WHEREAS, on October 8, 1997, a notice of appeal of the Board's decision was filed with
the City Clerk by Mayor Ann Azari; and
WHEREAS, on November 18, 1997,the City Council, after notice given in accordance with
Chapter 2, Article I1, Division 3 of the City Code, considered said appeal, reviewed the record on
appeal and heard presentations from the staff and other parties in interest; and
WHEREAS,City Code Section 2-56(e)provides that no later than the date of its next regular
meeting after the hearing of an appeal, City Council shall adopt, by resolution, findings of fact in
support of its decision on the appeal.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that pursuant to Section 2-56(e)of the City Code,the Council hereby makes the following
findings of fact and conclusions:
Section 1. That the notice of appeal conforms to the requirements of Section 2-48 of the
City Code.
Section 2. That the Commission on Disability was not notified of the hearing before the
Board and did not have an opportunity to attend said hearing and present its comments and/or
concerns and, accordingly,neither the Commission nor its members qualified as"parties in interest"
to present argument to the City Council at the time it heard this appeal on November 18, 1997.
Section 3. That the Board should have the benefit of receiving input from the
Commission on Disability prior to its rendering a decision in the matter.
Section 4. That the Council, in accordance with Section 2-56(d)(2)hereby remands the
matter for a rehearing in order for the Board to receive and consider additional information from the
Commission on Disability with regard to the Project and the proposed variance.
Passed and adopted at a regular meeting of the City Council held this 2nd day of December,
A.D. 1997.
