OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN AGREEMENT WITH THE COLORADO DEPARTMENT OF
TRANSPORTATION AND THE UNION PACIFIC RAILROAD COMPANY
FOR INSTALLING NEW CROSSING WARNING DEVICES AT THE
LARIMER COUNTY ROAD 32 AND UNION PACIFIC RAILROAD CROSSING
WHEREAS, the City and the Union Pacific Railroad Company ("Union Pacific") desire to
install new crossing warning devices at the Larimer County Road 32 and Union Pacific Railroad
crossing; and
WHEREAS, Federal Intermodel Surface Transportation Efficiency Act ("ISTEA") funds
have been made available to pay for one hundred(100)percent of the cost of installing new crossing
warning devices; and
WHEREAS, the City has sufficient Minor Streets Capital Funds to reimburse the Colorado
Department of Transportation for its costs in administering the project, which costs are estimated
to be in the sum of Two Thousand Two Hundred and Forty Two Dollars ($2,242); and
WHEREAS,the costs of the project are estimated by Union Pacific to be in the sum of One
Hundred Twenty Six Thousand Seven Hundred and Fifty Eight Dollars ($126,758); and
WHEREAS, ISTEA funds are available in the maximum amount of One Hundred Thirty
Four Thousand Two Hundred and Fifty Eight Dollars ($134,258) to fund the project; and
WHEREAS, the City, the State of Colorado and Union Pacific now desire to enter into a
contract for the purpose of accomplishing the installation of new crossing warning devices at the
Larimer County Road 32 and Union Pacific Railroad crossing; and
WHEREAS, Section 16 of Article 11 of the City Charter provides that the Council may, by
resolution, enter into contracts with other governmental bodies to furnish governmental services or
to enter into cooperative or joint activities with other governmental bodies; and
WHEREAS, the Council had determined that the aforesaid contract for the installation of
new crossing warning devices is in the best interest of the City.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Council hereby approves the Contract between and among the City,the State
of Colorado and the Union Pacific Railroad Company,and authorizes the City Manager to enter into
the Contract on behalf of the City,which contract provides that one hundred(100)percent of the cost
to install the aforesaid new crossing warning devices shall be funded by Intermodel Surface
Transportation Efficiency Act funds and the cost incurred by the State of Colorado in administering
the project shall be reimbursed by the City to the State in the estimated sum of Two Thousand Two
Hundred and Forty Two Dollars ($2,242), from City Minor Streets Capital Funds.
