HomeMy WebLinkAbout1998-056-03/17/1998-AMENDING POLICY GM-2.1 ANNEXATION POLICIES OF THE CITY PLAN PRINCIPLES AND POLICIES RESOLUTION 98-56 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING POLICY GM-2.1 "ANNEXATION POLICIES" OF THE CITY PLAN PRINCIPLES AND POLICIES WHEREAS,as apart ofthe process of developing the amendments to the intergovernmental agreement for the Fort Collins Urban Growth Area,it became apparent to the Council and to the staff of the City that Policy GM-2.1 "Annexation Policy"should be amended to allow for the annexation, within the urban growth area boundary, of property which has any contiguity to the City limits; and that the City should consider annexation of developed lands even though they may have substandard infrastructure provided that it is clear that the City will not accept maintenance of such infrastructure until the infrastructure is upgraded to City standards; and WHEREAS,the Council has determined that it is in the best interests of the City that Policy GM-2.1 "Annexation Policy"of the City Plan Principles and Policies document should be amended accordingly. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, that Policy GM-2.1 "Annexation Policy" of the City Plan Principles and Policies document be, and hereby is, amended by changing the subparagraphs entitled "Annexation of County Enclaves" and "Infrastructure Standards"to read as follows: Annexation of county enclaves. The City will pursue annexation of vacant/undeveloped land included in a county enclave (i.e. an area completely surrounded by property already in the City) within one year after such enclave becomes eligible for involuntary annexation. Infrastructure standards. Developed land,or areas seeking voluntary annexation, must have their infrastructure improved (e.g., streets, utilities and storm drainage systems) to City standards, or must have a mechanism (e.g. a special improvement district, capital improvements program, etc.) in place to upgrade such services and facilities to City standards before the City will assume full responsibility for future maintenance.
