OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE CONCEPTUAL DESIGN
OF THE CIVIC CENTER PARKING STRUCTURE
WHEREAS, the City, Larimer County (the "County") and the Fort Collins Downtown
Development Authority (the "DDA") share a common interest in providing adequate parking to
meet the needs of their respective constituents,and it is in the best interests of these constituents that
the City, the County and the DDA work cooperatively toward that end; and
WHEREAS, the City, the County and the DDA have previously agreed to certain shared
responsibilities to enable the construction, operation and maintenance of a parking structure to be
located on Block 21 of the City according to the recorded plat thereof("Block 21") in downtown
Fort Collins to the east across Mason Street from the Justice Center,consistent with the City's Civic
Center Master Plan (the "Civic Center Parking Structure" or the "Parking Structure"); and
WHEREAS, on June 17, 1997, the Council adopted Resolution 97-91, authorizing an
Intergovernmental Agreement by and Among the City of Fort Collins, Colorado, the County of
Larimer, Colorado and the Fort Collins, Colorado Downtown Development Authority, which was
signed and effective on July 3, 1997 (the "IGA"); and
WHEREAS, the IGA provided that the design of the subject parking structure would be
submitted to all the parties thereto for approval; and
WHEREAS,on June 30, 1998,the Board of County Commissioners of the County approved
a proposed conceptual design for the Parking Structure, as the same was presented by the City (the
"Conceptual Design"); and
WHEREAS, on July 2, 1998, the Board of Directors of the DDA considered and approved
said Conceptual Design; and
WHEREAS,the City is in the process of arranging for Lease Certificates of Participation to
finance the development and construction of the Parking Structure, including among other aspects,
the lease of the underlying real property to the Fort Collins Capital Leasing Corporation("FCCLC")
by the City, the assignment of certain rights of FCCLC to a Trustee under the terms of a trust
indenture between them, and the lease of the Parking Structure site by the City from the FCCLC;
and
WHEREAS, the City has requested proposals for, and has selected, a contractor for the
design and construction of the Parking Structure; and
WHEREAS, the City and the County have jointly developed a Civic Center Master Plan,
which establishes, as a planning tool, the various uses and developments that the parties seek to
encourage and facilitate as a civic and government center in Fort Collins; and
WHEREAS, the Conceptual Design for the Civic Center Parking Structure has been
presented to the Council, and based on its review and consideration of its relationship to the Civic
Center Master Plan,has determined that the Conceptual Design is consistent therewith and with the
Council's intent and expectations in that regard.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Conceptual Design for the Civic Center Parking Structure, as presented to the
Council at the regular meeting of the Council on this same date,be,and hereby is,approved,subject
to such minor modifications in form or substance as the City Manager may deem necessary to
effectuate the general objectives of such Conceptual Design.
