OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
INTERGOVERNMENTAL AGREEMENT WITH
COLORADO ASSOCIATION OF TRANSIT AGENCIES AND OTHER TRANSIT
AGENCIES TO OBTAIN CERTAIN FEDERAL FUNDS
FOR CAPITAL PROJECTS FOR TRANSIT
WHEREAS, the City of Fort Collins operates a fixed route bus system ("Transfort") offering
citizens a safe, dependable alternative mode of transportation to various locations throughout the
City; and
WHEREAS, the Federal Transit Administration administers a grant program, called the
Section 5309 program, intended to fund capital improvements for transit agencies such as Transfort;
and
WHEREAS,City staff has determined that a joint effort to request and lobby for such Section
5309 capital projects funds among Colorado transit agencies would enhance the prospects for
obtaining such federal funds; and
WHEREAS, the Colorado Association of Transit Agencies ("CASTA") has agreed to
coordinate and manage the process of seeking such a statewide Section 5309 allocation, and the ten
Colorado transit agencies desirous of obtaining such funds have reached a proposed agreement
regarding the means for proceeding with such a joint statewide request (the"Agreement"); and
WHEREAS, the Agreement calls for the proportional sharing of the costs of hiring a
consultant to work with Congress to advance the statewide funding request among the ten
participating transit agencies; and
WHEREAS,the Agreement further provides for the proportional sharing of the resulting total
allocation of Section 5309 funds among the participating agencies, with some exceptions to provide
for maximum utilization of such allocated funds; and
WHEREAS, the City of Fort Collins' request for Section 5309 funds totals $1,632,800, and
seeks federal funds for three replacement buses, eight replacement minibuses, and four replacement
vans, as well as technology improvements for vehicle tracking and passenger counting, and the
design and construction of two bus pullouts; and
WHEREAS, the funds required to pay the City's share of the costs to be incurred under the
Agreement are budgeted and have been appropriated for such use in the Transit Fund; and
WHEREAS, the City's request comprises approximately 11.5 Percent of the total joint
request, and the City's share of the expenses of the joint effort would be $9,557, or 11.5 Percent of
the total anticipated expenses; and
WHEREAS, the City Council has determined that seeking Section 5309 funds for the City
through the proposed statewide request would be in the best interests of the City, and has further
determined that the Agreement establishes an appropriate and effective means for advancing those
interests; and
WHEREAS, Article II, Section 16 of the City Charter provides that the Council may enter
into agreements with other governmental bodies for the performance of cooperative or joint
activities.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Manager be, and hereby is, authorized to execute, on behalf of
the City, an agreement with the Colorado Association of Transit Agencies ("CASTA"), Northeastern
Colorado Transportation Authority aka/County Express(Logan County),Development Opportunities
aka/Ride Transit (Canon City), Durango Lift (City of Durango), Special Transit (City and County
of Boulder), Mountain Express (Town of Crested Butte), Eagle County Regional Transportation
Authority (Eagle County), Summit Stage (Summit County), Town of Telluride (Telluride), and
Roaring Fork Transit Agency (City of Aspen)for the sharing of administrative and congressional
lobbying services for a statewide Section 5309 funds request, which agreement shall include the
following terms, and such other terms not inconsistent with the following as the City Manager may
deem necessary to protect the interests of the City:
a. The participating transit agencies, including the City of Fort Collins (Transfort) will
provide to CASTA their requests for capital funds through the Section 5309 program,
including supporting information as needed, which individual requests will be
combined and presented to Congress as a statewide request for Section 5309 capital
funds.
b. CASTA will retain a lobbyist experienced in transit funding issues and familiar with
the congressional process for determining Section 5309 allocations, and will provide
for lobbying in support of the statewide request in exchange for payment of$75,000
for such services.
C. CASTA will receive payment in the amount of$7,500 as payment for its services in
administering and coordinating the statewide request for funds.
d. The parties shall pay a proportional share of the total cost of$82,500, based on the
capital requests submitted by each.
e. The parties shall agree to proportional sharing of the resulting total allocation of
Section 5309 funds among the participating agencies, with some exceptions to
provide for maximum utilization of such allocated funds.
f. The term of the agreement shall be through the end of federal fiscal year 1998, with
a provision allowing any participating transit agency to terminate its participation in
the agreement with thirty days' written notice.
Section 2. That the City Manager may, if he deems it to be in the best interests of the
City, extend the Agreement for up to four(4) additional years (through federal fiscal year 2002) and
make such modifications to the Agreement, or any extension thereof, as he may, after consultation
with the City Attorney, consider necessary to protect the City's interest and advance the City's
request for federal funds for capital transit projects.
