OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING A GROUND LEASE OF CITY-OWNED
PROPERTY ON BLOCK 33 TO NIGHTWALKER ENTERPRISES, INC.
WHEREAS, the City of Fort Collins is the owner of property on Block 33, City of Fort
Collins, Latimer County, Colorado; and
WHEREAS,Nightwalker Enterprises, Inc. (Nightwalker) has requested that the City lease
to it approximately 360 square feet of ground space in the southwestern corner of the City-owned
property on Block 33 as shown on Exhibit A, attached hereto and incorporated herein by this
reference (the "Leased Premises") to Nightwalker Enterprises, Inc.; and
WHEREAS, Nightwalker has agreed to pay to the City the amount of Three Hundred and
Sixty Dollars ($360.00) in exchange for the short term lease of the Leased Premises, which will
result in unanticipated revenue for the otherwise unused property; and
WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is
authorized to lease any and all interests in real property owned in the name of the City,provided that
Council first finds that the lease is in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council hereby finds that the lease of the Leased Premises to
Nightwalker in accordance with the terms of this Resolution is in the best interests of the City of Fort
Collins.
Section 2. That the City Manager is authorized to enter into a lease agreement for the
purpose of leasing the Leased Premises to Nightwalker through March 31, 1999,for a lease payment
amount of Three Hundred Sixty Dollars ($360.00). together with such additional terms and
conditions as the City Manager,in consultation with the City Attorney,determines to be appropriate
to protect the interests of the City.
