HomeMy WebLinkAbout1998-146-10/20/1998-AUTHORIZING AN IGA WITH BOULDER COUNTYS LONGS PEAK ENERGY CONSERVATION PROGRAM FOR ADMINISTRATION OF RESOLUTION 98-146 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH BOULDER COUNTY'S LONGS PEAK ENERGY CONSERVATION PROGRAM FOR ADMINISTRATION OF THE CITY'S REACH (RESIDENTIAL ENERGY ASSISTANCE THROUGH COMMUNITY HELP) PROGRAM WHEREAS, in 1984, the City of Fort Collins (the "City") started the Residential Energy Assistance through Community Help Program (the "REACH Program"); and WHEREAS, the REACH Program provides Fort Collins residents who meet certain low- income guidelines with free services to weatherize their homes,thereby serving the public purpose of saving energy and money and improving the comfort for such residents; and WHEREAS, until the spring of 1997, the City had an agreement with the Larimer County Office of Weatherization("Latimer County") to take applications for the REACH Program and to complete the weatherization improvements for the City's qualifying residents; and WHEREAS, Larimer County offered these services as part of the Federal Low Income Energy Assistance Program (the "LEAP Program"); and WHEREAS, recently in a statewide bidding process Larimer County lost its State contract to provide such services under the LEAP Program in Larimer, Gilpin and Boulder Counties; and WHEREAS,the Long's Peak Energy Conservation,a division of Boulder County("Boulder County"), was awarded the State contract for the LEAP Program; and WHEREAS,Boulder County has agreed to enter into an Intergovernmental Agreement with the City to provide the REACH Program services to qualifying City residents as they were previously provided by Latimer County; and WHEREAS, the terms and conditions under which Boulder County will provide such services to the City, are set forth in the Agreement attached hereto as Exhibit"A"and incorporated herein by reference (the "Agreement"); and WHEREAS, pursuant to C.R.S. §29-1-203 the City and Boulder County may cooperate together to provide any function legally authorized to each; and WHEREAS, the City desires to enter into the Agreement with Boulder County so that the REACH Program can be continued for qualifying City residents. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be, and hereby is,authorized to execute the Agreement whereby Boulder County will administer the REACH Program for the City in accordance with the terms and conditions of the Agreement. Passed and adopted at a regular meeting of the City Council he ,this 20th day of O ber A.D. 1998. j " M—yor ATTEST: �4�lm ki City Clerk ' EXHIBIT A AGREEMENT THIS AGREEMENT is entered into this _ day of , 1998, by and between THE CITY OF FORT COLLINS, COLORADO ("City"), and LONGS PEAK ENERGY CONSERVATION, a division of Boulder County, Colorado ("County"). WITNESSETH: WHEREAS, the City desires to offer the Residential Energy Assistance through Community Help ("REACH") program for the benefit of the citizens of the City, as said program is described in Exhibit "A" attached hereto and incorporated herein by this reference; and WHEREAS, the County desires to assist in providing weatherization services to persons living in Larimer County which includes the City of Fort Collins; and WHEREAS, the County currently provides services of this type in Boulder, Gilpin and Larimer counties utilizing federal, state and local funds; and WHEREAS, both the City and the County provide services for the citizens of the City and wish to avoid duplication of services and maintain a high level of stewardship with the public's funds; and WHEREAS, pursuant to Article XIV, Section 18 of the Constitution of the State of Colorado, and statutes enacted pursuant thereto, the City and the County may cooperate together to provide any function lawfully authorized to each. TO ACCOMPLISH THE FOREGOING, the parties hereto, for good and valuable consideration, agree as follows: 1. The City and County shall work together cooperatively to implement the REACH program as defined in Exhibit "A". 2. The City shall promote the REACH program, collect contributions for the program provide tax accounting information as may be needed by those who contribute to the program. 3. The County shall provide services to participants in the program, including, without limitation, receiving applications from interested participants, determining eligibility of potential participants and providing weatherization services to participants. The County shall maintain a record of participants' names, addresses where work has been done or is scheduled to be done, and expenses for weatherization per address. 4. The County agrees to use REACH funds for those eligible who have no other alternatives available for obtaining this type of service. 5. The County shall bill the City for weatherization expenses (up to $10,000 per year) incurred by the County in conducting the program. The County shall use the same pricing structure used for the Low Income Energy Assistance Program. 6. In addition, at the option of the City and the County, the Agreement may be extended for additional one year periods not to exceed four (4) additional one year periods. Pricing changes shall be negotiated by and agreed to by both parties and may not exceed the Denver - Boulder CPI-U as published by the Colorado State Planning and Budget Office. Written notice of renewal shall be provided to the Service Provider and mailed no later than ninety (90) days prior to contract end. 7. Both the City and the County reserve the right to terminate this Agreement upon sixty (60) days' written notice to the other party. 8. This Agreement constitutes the entire understanding of the parties; and shall not be construed to create an employer/employee relationship in either of the parties, the County being an independent contractor with respect hereto. 9. This Agreement shall not be assigned by either of the parties hereto without the prior written consent of the other party, nor shall the County use subcontractors to perform its obligations under this Agreement without prior written consent. 10. This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns. Customers of Fort Collins Utilities support REACH by adding voluntary contributions to their utility payments. The contributions are used to weatherize homes, saving energy and money and improving comfort for the residents. REACH services include, but are not limited to, safety testing of furnaces and water heaters; blower door testing for air leakage; insulation; duct sealing; furnace tune-ups, repair or replacement; low-flow showerheads; water heater blankets, and education. Improvements are expected to have a 10-year lifespan and a 2-to-1 benefit to cost ratio. Eligibility: To qualify,households must be within Fort Collins city limits and not exceed 200% of poverty income guidelines. Households also must not qualify for other government-sponsored weatherization programs. If necessary, priority will be given to lower income households. Weatherization Work: Longs Peak Energy Conservation, a division of Boulder County, will process applications and perform the weatherization services for residents within the City of Fort Collins. Longs Peak performs this type of work in Boulder, Gilpin and Larimer counties as part of the Low Income Energy Assistance Program (LEAP). The use of a paid, well- trained work force based in Loveland provides an efficient means for obtaining high- quality results. Charges include $20 per hour for labor; $50 per day for equipment; materials at cost; and mileage. Costs per home will depend on the improvements that are completed, and will typically range from $1,000 to $1,750.
