OF THE COUNCIL OF THE CITY OF FORT COLLINS
RECOMMENDING COUNTY APPROVAL OF A WAIVER OF THE
PUBLIC STREET CAPACITY PHASING CRITERIA OF THE UGA
AGREEMENT FOR THE FORT COLLINS IN-LINE SPORT RINK SPECIAL REVIEW
WHEREAS, the Intergovernmental Agreement for the Fort Collins Urban Growth Area
between the City of Fort Collins and Larimer County (the "UGA Agreement"), which establishes
the Fort Collins Urban Growth Area(the"UGA"),provides that the City Council shall have the right
to review and comment upon development proposals which request waivers to the phasing criteria
for development within the UGA; and
WHEREAS,Larimer County has forwarded to the City for its review and comment a waiver
request for the"Fort Collins In-line Sport Rink Special Review" whereby it has been requested that
a waiver be granted with respect to the public street capacity phasing criteria as set forth in the UGA
Agreement; and
WHEREAS, such development is located within the UGA and qualifies as an "in-fill"
development in accordance with the UGA Agreement and, therefore, is eligible for consideration of
a waiver of the phasing criteria requirement for public street capacity.
NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, that the Council hereby recommends to the Board of County Commissioners that the
requirements of the UGA with respect to the public street capacity phasing criteria, as defined in the
Larimer County Supplement Regulations,be waived as that requirement is or may be applicable to
the"Fort Collins In-line Sport Rink Special Review" on the condition that the street improvement
fee to be paid for this development at the time a building permit is issued, be at the commercial rate
of $11,150 per acre of developed land rather than at the industrial rate of $5,575 per acre of
developed land.
