OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE PURCHASING AGENT TO ISSUE A CHANGE ORDER EXCEEDING
$50,000 FOR PROFESSIONAL SERVICES FOR ENVIRONMENTAL CLEANUP
WHEREAS, the City and Western Environmental Technologies, Inc. ("Western") have
entered into a professional services agreement, dated June 3, 1996, pursuant to which Western
agreed to perform certain environmental services related to the City's right-of-way acquisition for
Phase II of Railroad Consolidation Project (the "Agreement"); and
WHEREAS, the extent and nature of the environmental cleanup services were predicted
based on the best information available at the time the work was planned; and
WHEREAS,the actual circumstances encountered in carrying out the environmental cleanup
required that additional work be undertaken and related additional costs incurred; and
WHEREAS, the foregoing additional services rendered necessitate a Change Order to the
Agreement; and
WHEREAS, the funds for the Change Order have been appropriated in 1996; and
WHEREAS, the additional cost to the City resulting from the Change Order will be
$140,000; and
WHEREAS, Section 8-160 of the City Code requires City Council approval of change orders
to professional services contracts exceeding $50,000.
NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Purchasing Agent be, and hereby is, authorized to enter into a Change Order to
the Agreement in the amount of$140,000 for professional services for the environmental cleanup
of the City rights-of-way for Phase II of the Railroad Consolidation Project.
Passed and adopted at a regular meeting of the Council of the Ci Fort Collins held this 20th
