OF THE COUNCIL OF THE CITY OF FORT COLLINS
MAKING FINDINGS OF FACT AND CONCLUSIONS REGARDING
THE APPEAL OF A DECISION OF THE PLANNING AND ZONING BOARD
RELATING TO THE HEARTHFIRE ODP AND HEARTHFIRE PRELIMINARY PUD
WHEREAS, on March 25, 1996, the Planning and Zoning Board("the Board") denied the
the Hearthfire ODP and Hearthfire Preliminary PUD (the "Project"); and
WHEREAS, on April 8, 1996, a Notice of Appeal of the Board's decision was filed with the
City Clerk by the Richards Lake Development Company (the "Appellant"); and
WHEREAS, the hearing on the appeal was initially scheduled for May 21, 1996 and was
continued to June 18, 1996 upon the request of the Appellant and those who appeared in opposition
to the appeal; and
WHEREAS, on June 12, 1996, the Appellant and Bridget Schmidt, appearing on behalf of
those opposed to the appeal, jointly requested that the Project be remanded to the Planning and
Zoning Board to address certain issues pertaining to neighborhood compatibility, health and safety
and the Land Use Policies Plan; and
WHEREAS,on June 18, 1996,the City Council considered the remand request of the parties-
in-interest and, there being no objection to said request by any other parties-in-interest, the Council
granted the request and remanded the matter to the Board, as permitted under Section 2-56(d)(2) of
the City Code; and
WHEREAS, Section 2-56(e) of the City Code provides that no later than the date of its next
regular meeting, the City Council shall adopt, by resolution, findings of fact in support of its
decision.
NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council hereby finds that additional information has been developed
by the parties-in-interest to this appeal relative to the issues of density, street design, lighting
standards, view corridors, pedestrian/bicycle/equestrian trails, on-site and off-site wetlands, the
impact and mitigation of existing oil and gas wells and the application of the Land Use Policies Plan.
Section 2. That the Hearthfire Overall Development Plan and Preliminary PUD is hereby
remanded to the Planning and Zoning Board for further consideration of the foregoing issues,in light
of such additional information and revisions to the ODP and PUD as may be submitted by the
Applicant.
Passed and adopted at a regular meeting of the Counc' the Cbty of Collins held this
