HomeMy WebLinkAbout1996-072-06/18/1996-COLORADO WATER METERING ACT DELAYED BILLING PROGRAM RESOLUTION 96-72 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING RESOLUTION 90-147 PERTAINING TO THE CITY'S POLICIES AND PROCEDURES TO COMPLY WITH THE COLORADO WATER METERING ACT IN ORDER TO IMPLEMENT A DELAYED-BILLING PROGRAM WHEREAS, on November 20, 1990, the Fort Collins City Council adopted Resolution 90- 14E approving the City's policies and procedures to comply with the Colorado Water Metering Act ("the Water Metering Act"); and WHEREAS, Resolution 90-147 was adopted to implement within the City a Water Meter Installation Program to comply with the provisions of the Water Metering Act; and WHEREAS,Section 9 of Resolution 90-147 initially provided that customers converted from non-metered to metered water service shall begin paying the metered water rate upon installation of the meter; and WHEREAS, experience eventually demonstrated that since water use is usually at its highest in the summer due to the irrigation of lawns, the number of water users volunteering for installation of a water reeler during the summer typically dropped; and WHEREAS, this drop in the number of users requesting installation of a meter during the summer made it difficult for the Water Utility to schedule installations, level out the workload over the year, and maintain an acceptable length of time between when a request is received and a meter is installed; and WHEREAS, in order to resolve these problems, City staff recommended and the Council adopted on May 17, 1994, Resolution 94-80 to provide for a delayed billing program whereby customers who apply for installation of a water meter during the period of June I to August 31 of any given year, may elect to begin paying the metered rate up to ninety (90) days after the installation, but in no event later than October I of that year; and WHEREAS, because under the existing delayed billing program, customers are required to begin paying the metered rate no later than October I of the year in which their ureter is installed, customers whose meters are installed in late summer or early fall do not receive the full ninety (90) days before having to begin paying the metered rate, which results in a disincentive for water users to volunteer for the installation of a water meter during late summer or early fall; and WHEREAS, it is therefore necessary and desirable for Section 9 of Resolution 90-147, as amended by Resolution 94-80, to be further amended to eliminate the requirement that customers begin paying the metered rate no later than October I of the year the meter is installed so that water users who have water meters installed in late sutnmer or early fall receive benefit of the delayed billing program. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That Section 9 of Resolution 90-147, as amended by Resolution 94-80, is hereby amended, and a new Section 10 is hereby added, to read as follows: Section 9. That the City's existing metered water rate for residential customers accurately reflects the cost of providing metered water service to single family homes and duplexes. Section 10. That customers who have water meters installed during the period of June l to August 31 of any year may elect to continue to be charged the flat rate for the customer's billing cycle in which the water teeter is installed as well as for the customer's next two billing cycles; provided, however, that beginning with the customer's fourth billing cycle after the installation of the water meter, and thereafter, the customer shall be charged the metered rate. Section 2.
