HomeMy WebLinkAbout1997-133-10/07/1997-PHASING CRITERIA PUBLIC STREET CAPACITY UDY SUBDIVISION WAIVER RESOLUTION 97-133 OF THE COUNCIL OF THE CITY OF FORT COLLINS RECOMMENDING COUNTY APPROVAL OF A WAIVER OF THE PUBLIC STREET CAPACITY PHASING CRITERIA REQUIREMENT FOR THE UDY SUBDIVISION WHEREAS, the Intergovernmental Agreement for the Fort Collins Urban Growth Area between the City of Fort Collins and Larimer County (the "UGA Agreement"), which establishes the Fort Collins Urban Growth Area(the"UGA"),provides that the City Council shall have the right to review and comment upon development proposals which request waivers to the phasing criteria for development within the UGA; and WHEREAS,Larimer County has forwarded to the City for its review and comment a waiver request for the Udy Subdivision("the Development") whereby it has been requested that a waiver be granted with respect to the public street capacity phasing criteria as set forth in the UGA Agreement; and WHEREAS,the Development is located within the UGA and the waiver, if granted, will not result in unplanned public expense for the provision of public services, improvements, or facilities; and WHEREAS, the financial impact of waiving the phasing criteria would be mitigated by charging a fee per dwelling unit based upon trip generation and associated impacts; and WHEREAS,the requested waiver is consistent with the intent and purpose of the County and adjoining municipality's land use plans and policies; and WHEREAS, the requested waiver will not result in an unplanned public expense; and WHEREAS,the requested waiver will not jeopardize the public health, safety or welfare and the intent and purposes of the UGA Agreement will not be compromised by the granting of such waiver. NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, that the Council hereby recommends to the Board of County Commissioners that the requirements of the Intergovernmental Agreement for the Establishment of the Fort Collins Urban Growth Area with respect to the public street capacity phasing criteria, as defined in the Larimer County Supplemental Regulations,be waived as that requirement is or may be applicable to the Udy Subdivision, provided that the County collects a fee per dwelling unit, upon terms and conditions acceptable to the City Manager, the amount of which fee shall be based upon trip generation and associated impacts as determined by the Larimer County Engineering Department and the City Engineer.
