OF THE COUNCIL OF THE CITY OF FORT COLLINS
RECOMMENDING COUNTY APPROVAL OF A WAIVER OF THE
CONTIGUITY TO EXISTING DEVELOPMENT PHASING CRITERIA OF THE
UGA AGREEMENT FOR THE UDY SUBDIVISION
WHEREAS, the Intergovernmental Agreement for the Fort Collins Urban Growth Area
between the City of Fort Collins and Larimer County (the "UGA Agreement"), which establishes
the Fort Collins Urban Growth Area(the"UGA"),provides that the City Council shall have the right
to review and comment upon development proposals which request waivers to the phasing criteria
for development within the UGA; and
WHEREAS,Larimer County has forwarded to the City for its review and comment a waiver
request for the Udy Subdivision ("the Development") whereby it has been requested that a waiver
be granted with respect to the contiguity to existing development phasing criteria as set forth in the
UGA Agreement; and
WHEREAS,the Development is located within the UGA and is(1)consistent with the intent
of the City's Structure Plan, (2) compatible with historic development patterns of northwest Fort
Collins, and (3) compatible with the land uses located adjacent to the proposed site; and
WHEREAS, the requested waiver will not result in an unplanned public expense; and
WHEREAS,the requested waiver will not jeopardize the public health, safety or welfare and
the intent and purposes of the UGA Agreement will not be compromised by the granting of such
waiver.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, that the Council hereby recommends to the Board of County Commissioners that the
requirements of the Intergovernmental Agreement for the Establishment of the Fort Collins Urban
Growth Area with respect to the contiguity to existing development phasing criteria, as defined in
the Larimer County Supplemental Regulations, be waived as that requirement is or may be
applicable to the Udy Subdivision.
