OF THE COUNCIL OF THE CITY OF FORT COLLINS
EXPRESSING SUPPORT FOR STATE GROWTH MANAGEMENT LEGISLATION
WHEREAS, unplanned and uncoordinated growth threatens both the quality of life of
Coloradoans and the treasured natural environment of Colorado; and
WHEREAS, sprawling development patterns result in the costly and inefficient provision
of governmental services including transportation services; and
WHEREAS, sprawling development patterns in certain other areas of Colorado have
depleted state transportation resources because of the transportation deficiencies created by such
sprawl, while the North Front Range remains deficient in transportation funding to meet its
transportation needs; and
WHEREAS, the North Front Range Metropolitan Planning Organization region has
projected transportation needs totaling $1.3 billion over 20 years, with resources of $205.8
million, leaving an unfunded balance of$1.09 billion; and
WHEREAS, because of Colorado's rapid growth, certain Colorado communities are
extending their boundaries with the result that such communities will merge into an extended
metropolitan area with no apparent boundaries or separation; and
WHEREAS, in order to encourage better state growth management, the Council of the
City of Fort Collins desires to support state legislation which will lead to more effective regional
land use and transportation planning; and
WHEREAS, in its 2000 Legislative Agenda, the City Council has expressed its support
for state legislation that establishes a baseline of consistent and coordinated fundamental land
use and transportation planning within the state's rapidly growing communities and regions; and
WHEREAS, the Council wishes to add greater specificity to its Legislative Agenda
section regarding planning and land use; and
WHEREAS, the Colorado Municipal League is preparing for presentation to the
Colorado Legislature a bill which would enable local governments to provide consistent and
coordinated fundamental land use and transportation planning; and
WHEREAS, the Colorado Municipal League proposal, while providing enabling
legislation, would not mandate local governments to perform such consistent and coordinated
planning, and, accordingly is deficient in that regard.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That the Council hereby reaffirms its support for state legislation that
establishes a baseline of consistent and coordinated fundamental land use and transportation
planning within the state's rapidly growing communities and regions.
Section 2. That state legislation should be enacted to require communities and
regions within Colorado that are experiencing rapid growth to approve the establishment of
urban growth boundaries and adequate public facility requirements.
Section 3. That state land use/planning legislation should also be enacted to require
communities and regions within Colorado that are experiencing rapid growth to:
(a) adopt local comprehensive plans which include elements dealing with land use;
transportation; sensitive lands; affordable housing; and growth management
techniques including urban growth boundaries, local government provision of key
urban services, and a mechanism for regional coordination.
(b) adopt local land use and development policies which are based on credible,
researched population projections, set within certain tolerances of the state
demographer's projections.
Section 4. That state legislation should also be enacted to:
(c) reward communities for good planning and penalize them for noncompliance,
using distribution of discretionary state funding, and establish a rational,
measurable method for evaluating local government plans for compliance.
(d) establish a conflict resolution mechanism which provides for the speedy
resolution of disputes, as an alternative to litigation.
Section 5. That, while the Council is supportive of the bill introduced by the
Colorado Municipal League as a positive step towards more comprehensive statewide growth
management and planning legislation, the Council also believes that the Colorado legislature
should enact legislation consistent with the Council's growth management goals as stated in
Sections 1 through 4 of this Resolution.
Passed and adopted at a regular meeting of the City Council held this 18th day of
January, A.D. 2000.
