OF THE COUNCIL OF THE CITY OF FORT COLLINS
OPPOSING PROPOSED AMENDMENTS TO HOUSE BILL 1223
WHEREAS,the Colorado Municipal League(CML)has proposed for consideration by the
state legislature a bill which would enable local governments to provide consistent and coordinated
fundamental land use and transportation planning, which bill has been presented to the legislature
as HB 1223; and
WHEREAS,on January 18,2000,the City Council adopted Resolution 2000-23 supporting
HB 1223 as a positive step towards more comprehensive state-wide growth management and
planning, while also urging the state legislature to enact stronger growth management legislation
imposing certain planning requirements upon communities and regions within Colorado that are
experiencing rapid growth; and
WHEREAS, the City Council continues to support HB 1223 in its original form; and
WHEREAS,certain amendments have been proposed to HB 1223 which,in the City's view,
would seriously undermine the fundamental purposes of HB 1223 and severely curtail the ability of
home rule municipalities such as Fort Collins to deal effectively with growth management issues at
the local level; and
WHEREAS, these amendments would limit the length of time that cities would have to
provide services to annexed territories subsequent to their annexation and would, in effect,
automatically grant REAs and other certificated utilities a franchise to provide utility services to all
annexed areas of the City without the need for the City's consent to the franchise; and
WHEREAS,the City Council believes that HB 1223,if amended as described above,would
not be in the best interests of the City or other municipalities in the State of Colorado.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. The City Council continues to support HB 1223 in its original form.
Section 2. The City Council continues to support stronger growth management
legislation that would impose certain planning requirements upon communities and regions within
Colorado that are experiencing rapid growth, as described in Resolution 2000-23.
Section 3. The City Council opposes the above-mentioned amendments to HB 1223,
because such amendments: (1)are contrary to the purposes of HB 1223;(2)would interfere with the
City's ability to plan for local growth and provide municipal services to the annexed areas; and(3)
would infringe upon the City's constitutional and home-rule powers related to franchising.
Accordingly, the City Council opposes HB 1223 in its amended form.
Passed and adopted at a regular meeting of the City Council held this 15th day of February,
A.D. 2000.
