HomeMy WebLinkAbout2001-088-07/17/2001-AUTHORIZING THE MAYOR TO EXECUTE AN IGA WITH CSU FOR A COMMUNITY LIAISON COORDINATOR RESOLUTION 2001-88 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT WITH COLORADO STATE UNIVERSITY FOR A COMMUNITY LIAISON COORDINATOR WHEREAS,the City of Fort Collins and Colorado State University("CSU")have previously formed a joint task force to assess and advance solutions to neighborhood problems arising in areas dominated by student rentals; and WHEREAS,after three years of work,that task force,comprised of staff from both the City and CSU,has recommended that a Community Liaison Coordinator("CLC")position be established to create proactive and educational programs promoting positive relationship building in neighborhoods dominated by student rentals,including educational programs regarding the relevant requirements of the City Code; and WHEREAS, CSU and City staff have proposed that a CLC position,jointly funded by the City and CSU,be housed in the City's Neighborhood Resources Office,through which office space, computer,telephone service,and other basic administrative needs of the position would be met;and WHEREAS, a proposed Intergovernmental Agreement providing for the joint funding, purposes, and administrative arrangements for the CLC, attached hereto as Exhibit "A" and incorporated herein by this reference (the "IGA"),has been negotiated by staff consistent with the recommendations of the task force; and WHEREAS, the City funds required for 2001 for the CLC, in the total amount of$9,543, have been appropriated and are available in the Neighborhood Resources Office operating budget; and WHEREAS, City funds required for future fiscal years,in the amounts of$19,086 for 2002, and $9,865 for 2003, which are contingent upon future appropriation, have been included in the proposed budget for the Neighborhood Resources Office for those years; and WHEREAS,Article II,Section 16 of the City Charter and Section 29-1-203,C.R.S.,provide that the City Council may enter into agreements with other governmental bodies for the performance of cooperative or joint activities. NOW, THEREFORE, BE IT RESOLVED BY COUNCIL OF THE CITY OF FORT COLLINS that the Mayor is hereby authorized to execute the IGA between the City and Colorado State University,in substantially the form set forth on Exhibit"A",together with such modifications and additional terms as the City Manager, in consultation with the City Attorney, determines to be necessary and appropriate to protect the interests of the City. Mayor ATTEST: - - alla % <��Wa 4'-AA City Clerk EXHIBIT "A" INTERGOVERNMENTAL AGREEMENT CONCERNING COLORADO STATE UNIVERSITY COMMUNITY LIAISON COORDINATOR THIS AGREEMENT is entered into this day of , 2001, by and between COLORADO STATE BOARD OF AGRICULTURE, acting by and through Colorado State University for the Campus Activities Center, (the "University") and THE CITY OF FORT COLLINS, COLORADO, a municipal corporation (the "City"). WITNESSETH: WHEREAS, the City's Neighborhood Resources Office has been created to promote community-building and neighborhood cooperation, education and coordination within the City; and WHEREAS, the City's Neighborhood Resources Offices activities are of a local, and at times, multi-entity and inter-departmental in nature; and WHEREAS, the City desires to encourage positive relationships between student and non-student residents in neighborhoods in the City; and WHEREAS, Colorado State University desires to support it's students living off campus and promote positive neighborhood relationships between students and other City residents; and WHEREAS, it is in the best interests of both the City and Colorado State University to initiate and financially support a staff position funded by both entities to create and support community building in predominately student populated neighborhoods; and WHEREAS,the City desires to allocate funds to Colorado State University to support the salary and program operating expenses for the position of Community Liaison Coordinator. NOW, THEREFORE, in consideration of the mutual covenants and promises of the parties as hereafter provided and other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged, the parties agree as follows: 1. Services/Term. The City agrees to provide financial support and services to the University as are described in paragraph 2, upon the terms and conditions as are hereafter set forth. The term of service to be provided by the City to the University under this Agreement shall commence on July 18, 2001 and shall terminate on June 30, 2003, unless sooner terminated subject to the terms and conditions as are hereafter set forth. This Agreement may be terminated, without cause,by either party upon the giving of not less than sixty (60) days advance written notice to the other party. 2. Financial and Support Services. In providing financial and support services to the University for the Community Liaison Coordinator("CLC")position, the City agrees to perform the following: a. Upon invoice, the City will reimburse the University one-half of the actual cost of salary,benefits and program expenses for the CLC position in an amount not to exceed the allocations that follow: (i) City funds allocated to Colorado State University for the calendar year 2001 shall not exceed$9,543.00; (ii) City funds allocated to Colorado State University for the calendar year 2002 shall not exceed$19,086.00; (iii) City funds allocated for January 1, 2003 through June 30, 2003 shall not exceed $9,865.00; (iv) In addition to the above amounts, City funds allocated for program expenses shall not exceed $2,500.00 for 2001, $5,000.00 for the year 2002 and $2,500.00 for 2003; and (v)Payments shall be made quarterly beginning August 1, 2001 upon invoice from the University to the City, said payments shall be due and payable thirty (30) days after invoice. b. The City will provide office space, computer, and telephone service for the Community Liaison Coordinator in the Neighborhood Resources Office. c. The Parties agree to provide to the CLC, subject to applicable laws, including FERPA and the Colorado (Open)Records Act, the names, addresses and telephone numbers of neighborhood residents and representatives and student residents living off campus. d. The City will participate in providing professional development opportunities for the Community Liaison Coordinator in conjunction with the University. 3. Indemnification. The parties acknowledge that each are governmental entities that may not be permitted under current Colorado law to indemnify another entity, and further acknowledge that each party's agreement to indemnify the other is limited by applicable constitutions, statutes and case law. As such, to the extent by law, and consistent with the requirements of the Colorado Governmental Immunity Act(C.R.S. Section 24-10-101, et seq.), theUniversity hereby indemnifies and holds harmless the City from any loss, liability or damage, including attorneys' fees that the City may incur arising out of any negligent acts or omissions of the University in performing its duties under this Agreement. To the extent authorized by law, and consistent with the requirements of the Colorado Governmental Immunity Act(C.R.S. Section 24-10-101, et seq.), the City hereby indemnifies and holds harmless the University from any loss, liability or damage, including attorneys' fees that the University may incur arising out of any negligent acts or omissions of the City in performing its duties under this Agreement. 4. Additional terms and conditions: a. It is expressly understood that the Community Liaison Coordinator is an employee of the University and the University shall pay one hundred percent (100%) of the salary, benefits (including worker's compensation benefits), and pension costs and any other employment costs of said employee as said costs are incurred on behalf of the University. The City shall be responsible for reimbursing the University in the amount and manner set forth above in paragraph 2. b. The University will be responsible for hiring, discipline and firing of said employee. In exercising these responsibilities, the University shall consult with the City. The City will provide input and feedback to the CLC and the CLC's supervisor and shall participate in reviews, evaluations and planning for the CLC position. The City shall regularly advise the University of said employee's work performance and shall immediately report to the University any instances of alleged misconduct or discrimination. The Parties shall fully cooperate with the each other in the investigation of any allegations of misconduct or discrimination. c. For the purposes of this Agreement, Colorado State University hereby designates the Director of Off-Campus Student Services as its representative. The City designates the Neighborhood Resources Manager as its representative. Either party may change its designated representative at any time by written notice. d. This Agreement shall not be assigned, enlarged, amended, extended, modified, or altered, except in writing, signed by the parties as an amendment hereto. e. No waiver of any breach of this Agreement shall be held or construed to be a waiver of any subsequent breach hereof. f. This Agreement and the obligations of the parties hereunder, are expressly contingent upon the City budgeting and appropriating the funds needed to fulfill the City's obligations hereunder. g. No terms or conditions in this Agreement shall constitute a waiver of any provision of the Colorado Governmental Immunity Act. 5. Proper . Any property of the City that is used by the Community Liaison Coordinator shall be identified as property of the City and shall be returned to the City in the same condition, less normal wear and tear, upon termination of this Agreement. 6. Notice. Any notice required to be delivered in writing pursuant to this Agreement, said notice shall be hand-delivered or delivered via US Mail, postage prepaid addressed as follows: If to the City: Neighborhood Resources Manager City of Fort Collins P.O. Financial Obligations. All financial obligations of the University incurred pursuant to this Agreement are expressly contingent upon the University receiving funding appropriate for such expenditure from either the United States government or the government of the State of Colorado, or other authorized source. All financial obligations of the City incurred pursuant;o this Agreement are expressly contingent upon the appropriation of funds therefor by the City Council of the City. Individual members of the Council are not assessable and have no fiscal responsibility to meet the financial obligations of this Agreement. 11. Third Party Beneficiaries. This Agreement shall not be construed as or deemed to be an agreement for the benefit of any third party or parties, and no third party or parties shall have any right of action hereunder for any cause whatsoever. 12. Authori . The persons who have signed and executed this Agreement represent that they are duly authorized to execute this Agreement in their individual or representative capacity. 13. Entire Understanding. This Agreement shall be construed according to its fair meaning and constitutes the entire understanding and agreement between the parties hereto pertaining to the matters addressed in this Agreement. 14. Default. A party will be considered in default of its obligations under this agreement if such party should fail to observe, comply with or to perform any term condition or covenant contained herein and such failure continues for thirty(30) days after the non-defaulting gives the defaulting party written notice thereof. In the event of default, the non-defaulting party, upon written notice to the defaulting party, may terminate this Agreement as of the date specified in the notice and may seek such other and further relief as may be provided by law. Responsibilities: 1. Develops and implements opportunities to create positive relationships by educating, supporting, and assisting Colorado State University students and Fort Collins citizens. 2. Creates, implements, evaluates outreach programs to students and citizens about rights, expectations, and obligations of living in Fort Collins communities. 3. Develops neighboring programs for students transitioning from the residence halls into the community regarding the education of. • Code enforcement • Renters' Rights • Public Nuisance Ordinance • Three, Unrelated Persons Ordinance • Good Neighboring and responsible citizenship • Discover Neighbors, Discover Home Program 4. Works collaboratively in the creation of programs for students and citizens: • Creates a City link with CSU Judicial Affairs, HELP/Success Center, Greek Life, and related offices. • Acts as a point of contact in resolving neighbor/student controversies. • Acts as a conduit to establish direct relationships with students and citizens in relevant neighborhoods. • Makes public presentations representing good neighboring strategies in neighborhoods with a concentration of Colorado State University students. • Be available to attend appropriate meetings for the City and Colorado State University, including, but not limited to, the National Association for Residential Property Managers, Colorado Apartment Association, Neighborhood Taskforce, (etc.). • Establishes a direct relationship with public safety agencies. • Coordinate activities and problems with established neighborhood associations in relation to Colorado State University student issues. • Coordinates with property owners, property managers on issues associated with code enforcement, parking, neighbor relations, and public/private property improvements. 5. Assists in the hiring, training, and supervision of OCSS/NRO staff. 6. Keeps knowledgeable of landlord/tenant issues and resources available on campus and in the community. 7. Development and management of web page. 8. Develops a program evaluation system to include outcome measurements and benchmarks. 9. Assists with the development of long-range goals and objectives for the OCSS and NRO. 10. Carries out additional projects as directed by the NRO Manager and OCSS Director. Minimum Qualifications: 1. Bachelor's Degree Public Administration, Human Relations/Human Development, Education or related field 2. 2 years experience in program planning, implementation, and evaluation 3. Public speaking experience 4. Experience working with diverse populations 5. Strong interpersonal skills 6. Demonstrated mediation or counseling experience 7. Experience as a group facilitator 8.
