OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY
OF FORT COLLINS AND LARIMER COUNTY REGARDING STREET
IMPROVEMENTS AT SHIELDS STREET AND TRILBY ROAD
WHEREAS, Federal-aid funds pursuant to Title I. Subtitle A, Section 1108 of the
Transportation Equity Act of 1998 have been made available to Larimer County; and
WHEREAS,these grant funds are designated for construction of intersection improvements
including signalization at the intersection of County Road 17 and County Road 34 (Shields Street
and Trilby Road)in unincorporated Larimer County identified as CDOT ProjectNo.STS C060-029;
and
WHEREAS, the City has undertaken to install a temporary roving traffic signal at the
intersection and will replace the roving signal with permanent signals by September 30,2001,at an
estimated cost of$275,000.00; and
WHEREAS,the City Street Oversizing Program is authorized to reimburse for the costs of
permanent signal installation at arterial-arterial intersections including the intersection of County
Road 17 and County Road 34 (Shields Street and Trilby Road); and
WHEREAS,the County desires to pay funds to the City for the cost of the permanent traffic
signals and the City desires to reimburse funds to the County to be used by the County for
construction of road improvements beginning one-half mile south of Trilby Road identified as
Larimer County Project No. 234; and
WHEREAS,the County and the City have the authority pursuant to Article XIV, Section 18
of the Colorado Constitution and Section 29-1-201 et seq. Colorado Revised Statutes,to enter into
intergovernmental agreements for the purpose of providing any service or performing any function
which each can perform individually; and
WHEREAS, the Council of the City of Fort Collins has determined that it is in the best
interests of the City that the City Manager,pursuant to Section 1-19 of the Code of the City,execute,
on behalf of the City, said intergovernmental agreement.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and hereby is, authorized to execute that certain
intergovernmental agreement between the City and Larimer County regarding street improvements
at Shields Street and Trilby Road in substantially the form shown on Exhibit "A," attached hereto
and incorporated herein by this reference,with such modifications and additional terms as the City
Manager, in consultation with the City Attorney, determines to be necessary and appropriate to
protect the interests of the City.

AGREEMENT
THIS AGREEMENT is made and entered into this day of
2001,by and between the Board of County Commissioners of Larimer County,Colorado(for
the use and benefit of the Larimer County Public Works Department) ("County") and the
City of Fort Collins, Colorado, a municipal corporation ("City").
WHEREAS:
A. Federal-aid funds pursuant to Title I. Subtitle A, Section 1108 of the

NOW, THEREFORE, in consideration of the mutual covenants herein, the parties
agree as follows:
1. This Agreement shall be effective upon the day and year first written above.

2. City shall install permanent traffic signals at the intersection of County Road
17 and County Road 34 according to plans submitted to and approved by County.
Such installation shall be completed no later than September 30, 2001.
3. The County shall reimburse the City for the City's actual costs incurred in
connection with installation of the traffic signals, including design and construction costs.
The County shall reimburse the City within 30 days after County acceptance of the work and
receipt of the City's billing statement itemizing the City's actual costs.
4. Within 30 days of the County's payment to the City of the City's actual costs
for the traffic signals,the City shall reimburse to the County a like sum. The County shall
apply the City's funds to the County's costs of construction of road improvements beginning
one-half mile south of Trilby Road identified as Larimer County Project No. 234 .
5. The recitals are hereby made a part of this Agreement.
6. This Agreement shall be binding upon and inure to the benefit of the parties
hereto and their respective successors and assigns.
7. This Agreement shall be governed by the laws of the State of Colorado.
IN WITNESS WHEREOF,the parties hereto have executed this Agreement on the
day and year first written above.
