HomeMy WebLinkAboutINITIATED ORDINANCE - 04/05/1938 - COUNCIL-INITIATED ORDINANCE TO GRANT A REVOCABLE PERMIT FOR THE OPERATION OF BUSES WITHIN THE CITY LBE IT ORDAINED BY THE QUALIFIED VOTERS OF THE CITY OF FORT COLLINS: Section 1. The City Council is hereby authorized to grant a revocable permit for the operation of busses within the City limits of the City of Fort Collins, to take the place of the service now being rendered by the Municipal Street Railway System, said permit shall contain such conditions as the City Council may deem advisable, including the following, to-wit: (a). The routes shall be agreed upon between the City and the licensee, but in no event shall the daily miles covered be less than now covered by the street railway. The schedules of the runs shall not exceed 20 minutes. (b). The fares to be charged shall not be in excess of the fares now charged by the municipal street railway system. (c). The licensee shall agree that the speed of said busses shall not be operated in excess of 20 miles per hour, and that the operation of said busses shall at all times conform with the ordinances of the City now existing or hereafter adopted. (d). The licensee shall furnish and deliver to the City a good and sufficient surety bond in the penal sum of $10,000, to be approved by the Commissioner of Safety and conditioned that he shall fully conform with the permit to be executed, and shall at all times render efficient and adequate service to the citizens of Fort Collins. (e). The City Council shall have the right and power to regulate the rates, fares, use of transfers, runs and charges for service and the right to require uniform, convenient and adequate service to the public. (f). The licensee shall obtain and file with the City Clerk adequate public liability and property damage insurance and workmen’s compensation insurance. (g). The licensee shall operate not less than three busses of the most modern type, to be agreed upon between the licensee and the City Council. (h). Any expense in connection with the granting of said license shall be borne by the licensee. (i). The licensee, so far as possible, shall employ local residents in the operation and conduct of its business and shall give present employees of the municipal street railway preference. (j). The licensee shall pay to the City annually for the use of the streets, such amount as may be fixed by the City Council, but not less than 1% of the gross revenues. Section 2. When a permit for the operation of busses as provided in Section 1 hereof is granted, then the City Council is hereby authorized and directed to cease operation of the municipal railway and to dismantle all or such part of said municipal street railway property as may be deemed advisable, and to sell and dispose of so much thereof as may be by said City Council deemed advisable and the net proceeds derived from the sale of said property shall be used for the payment of indebtedness due the City of Fort Collins by the municipal railway.
