OF 1908.
AN ORDINANCE FOR THE PFCTECTICN OF STFEAS_ ABOVE THE
CITY'S SOURCE OF WATER SUPPLY, FROM. NUISANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. The construction or keeping of any barn, stable,
cattle yard, feed lot, chicken yard, pig pen, or any grounds or•
premises of whatever kind, the drainage from which is capable
of contaminating or rendering the water impure and unwholesnme ,
is hereby prohibited upon the Cache la Poudre Fiver and upon
the banks thereof from the intake or point of diversion of
water of the pipe-line of the City of Fort Collins in the T'orth
East Cuarter ( NE 1/4) of the South East quarter (SE 1/4) of
Section 32, Township 9 North, Range 7C Test in L.arimer County,
Colorado, to the distance of five miles upon said river above
said intake; and the maintenance of any such place or places
is hereby declared a nuisance.
Sec. 2. If any person or persons within the distance of
five miles above the point where the water supply of this city
is diverted shall allow any offensive or unwholesome substance
to remain: upon his preriaes in such position that such substance
or the drainage therefrom, may be carried by natural causes into
said Cache la Poudre Fiver, or who shall permit to flow from
any place or premises any foul or contaminating fluid into such
stream, he shall be deemed guilty of a nuisance.
Sec. 3 . Any person violating any of the provisions of this
ordinance , upon conviction, shall be fined riot less than Twenty-
five ( "25) nor more than Two Hundred ( 620C) Dollars for each
offense '
