BE IT ORDAIITED BY THE CITY COUIICIL OF TIT' CITY OF FORT COLT,- j
IN$, COLORADO:-
Section I. That any person or persons, co-part-
nership or corporation who shall keep a store, : , roam
or other , lace and shall vend, offer or expose for sale or retail
any goods, wares or merchandise within the City of Fort Collins as
hereinafter provided, shall be fined upon conviction in any sum
not less than nor more than
for each offense ; PROVIDED, that this ordinance shall
not be construed to apply to the sale of goods, wares and mer-
chandise by merchants who p,y an annual City tax upon such goods,
mares and merchandise assessed according- to the revenue laws of
this State, nor to travelling agents who sell samples to regular
merchants doing business in the said City of Fort Collins , nor
to the sales of goods for charitable and non-profitable purposes.
Each sale shall constitute a separate and distinct offense.
Section 2. The manaer or other person or persons
in control of such store, place or stock of goods , whether he is
the owner, or not, of said goods offered or exposed for sale shall )
be subject to the penalties imposed by this ordinonce for selling,
offering to sell, or exposing for sale , goods, wares and merchandige

as aforesaid without a license therefor as aforesaid.
Section 3. That from and after this ordinance
goes into effect any person, co-partnership or corporation keeping
a place as aforesaid for the sale of goods as aforesaid, or selling
or offering to sell goods, dares and merchandise as aforesaid,
Wand not paying an annual tax as hereinabove provided shallr�in

Section 4. It shr-.11 be sufficient defense to an
action for a violation of the ordinance to establish that the owner
of the stock, of goods has been in the City regularly assessed upon
his stock of goods and paid City taxes pursuant to the revenue
laws of the State, or that he has permanently engaged in such
business in the City and has arranged to remain in business in
this City for at least a year, or that he has been continuously
in such business in this City for a year prior to the time of the
alleged violation of this ordinance.
Section 5. Any merchant who shall remain contin-
uousl,. _n business until after the annual tax for the city purpose
has been assessed against his stock of goods, and shall show satis-

Section 6. The license issued under the authority
of this ordinance shall be issued and signed by the Mayor and Clerk
in accordance with the provisions of the General license ordinances,
bit shall designate that the licensee has been licensed to carry
on business as a transient merchant and shall designate the place
