SHOWS CIRCUSES MEIIAGERIES PUBLIC DANCES AND ALL FORMS OF PUBLIC A1USP.I'riENTS PROVIDING FOR THE ISSUING OF LICENSES &'D THE REGULATION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOPT COLLIYS Section 1 It shall be unlawful for any person or persons to produce conduct or carry on any public exhibition show circus menagerie public dance or any other form of public amusement ^herein an admission fee is charged without first having procured a license therefor from the City Clerk in the manner hereinafter provided Provided however that home entertainments of a charitable or social nature where admission thall be charged shall be exempt from the provisions of this ordinance except that no such charitable or social entertain- ment shall be given wherein an admissio� fee is to be charged unless a permit be obitained from the City Council as herein provided Section 2 Any person or persons desiring a license or permit shall file with the City Clerk an application therefor in writing setting out the full name of the a plic t the kind of show or public entertainment to be licensed` the place where the same is to be given or the building or theater sought to be licensed and in case of a circus and menagerie or dog and pony show the number of railroad cars used in transporting and conveying such circus menagerie or clog and pony show as well A � as the location of the place where the same is given Said application shall be accompanied by the fee required for such show or entertainment except charitable or social entertain- ments and thercupon the Citv Clerk shall present said application to the City Council for cons The City Council may then order said license�to be issued provided it is determined A by said Council that it is in the interest of public service and good morals of said city so to do and when so ordered said license shall be signed by the Commissioner of Safety and Ex- Officio Mayor and attested by the City Clerk and in the event it is issued to a circus menagerie or dog and pony show the City Council shall ap -)rove the streets and avenues of the city over which the equipment of"such circus menagerie or show shall be driven Provided that in the event of an emergency and a meeting of the City Council cannot be had in am le time to o provide for the issuing of any license s herein provided then the Commissioner of Safety and Ex-offffi�c^iooIayor may approve such and application an cause such licete t' o be issued and the said Commissioner of Safety and Ex-officio Mayor shall be the sol(e judge of the emergency in such circumstances Section 3 The license fee to be charged as provided in Section 1 of this ordinance shall be as follows ✓All theaters opera houses skating rinks and public buildings where theatrical sleight-of-hand musical or other entertainments shall be given the proprietor owner or manager shall pay the sum of Sixty Dollars (�60 00) per annum in advance ✓f For all circuses menageries or circuses and menageries combined with all its property equipment and supplies of every kind used for its transportation where not over forty (40)�\cars are used One Hundred Dollars ($100 00) per day and for each railroad car occupied or used by said show in excess of forty cars Two Dollars and fifty cents (• 2 50) per day per car ✓For each dog and pony show where all its property equipment and supplies of every kind used for its trans- portation does not exceed five (5) railroad cars Twenty- -2- r R five Dollarss($25 00) per day and for ten (10) railroad cars Fifty Dollars ($50 00) per day �Qmr ten (10) railroad cars Two Dollars and fifty cents (y2 60) per day per car ✓All street or tent shows Fifteen Dollars ($15 00) per day for each and every tent employed in giving said show / Public dances Two Dollars and fifty cents ($2 50) per night or day as the case may be, INo license issued as herein provided shall be trans- ferable, and may be revoked by the City Council upon conviction of the licensee of any violation of any of the provisions of this ordinance or upon good cause shown to the satisfaction of the City Council, and all permits shall be subject to the same conditions as to revocation Section 4 Licenses issued under the terms of this ordinance shall contain a provision authorizing and empower- ing the Commissioner of Public Safety and Ex-officio Mayor and any member of the police force to be admitted free at all times to such public exhibitions shows circuses menageries and all forms of public amusement for the purposes of inspec- tion and determingin whether said shows public entertainments and amusements are being given in accordance with the require- ments of the ordinances of the City of Fort Collins and that the same are being conducted in a decent and orderly manner and to this end all police are charged with the duty of enforcing the ordinances of said clty in connection r-ihh said public shows or entertainments and at all times to prevent any unseemly or indecent conduct in connection therewith Section 5 For the purpose of providing a board of inspection in the event any complaint is made respecting the character or kind of show to be given in any public hall theater or other place the Commissioner of Safety Commissioner -3- �l of Public Works and Commissioner of Finance are hereby con- stituted a board of inspection for the purpose of determingng whether it is in the interests of public morals and good conduct that any proposed show should or should not be given at any public hall, theater or other public place of amusement, and the decision of said board of inspection is hereby declared to be the exercise of reasonable discretion of said board in the interests of public service and morals of the city. Section 6 Any person or persons violating any of the Jprovisions of this ordinance shall, on conviction thereof, be fined in y sum not less than Ten Dollars ($10.00) nor more than Troy/Hyndred Dollars ($200.00) , with costs of suit, and in the event that such fines and costs af'e not paid, shall be confined in the city Jail one day for each Two Dollars of such fine and costs, not to exceed ninety (90) days Section 7 Ordinance No 2, 1891 "Relating to Licensing of Amusements and Public Halls, " passed and adopted April 8, 1891, and as amended by Ordinance No 20, of the Series of 1907, passed and adopted September 23, 1907, and all other ordinances and parts of ordinances in conflict herevith are hereby repealed, save and except that; all causes of action arising under said ordinances prior to the taking effect of this ordinance shall be deemed and held to be in full force and effect until the same have been determined by proper Judicial proceedings Passed and adopted this 2ti d of 1915.
