HomeMy WebLinkAbout013 - 05/21/1917 - RELATING TO THE REMOVAL OF TREES FROM THE PARKING ON STREETS OR ALLEYS AND PUBLIC GROUNDS WITHIN THE w ORDINANCE NO 1917 RELATING TO THE REMOVAL OF TREES FROM THE PARKING ON STREETS OR ALLEYS AND PUBLIC GROUNDS WITHIN THE CORPORATE LIMITS OF THE CITY OF FORT COLLINS, COLORADO BE IT ORDAIiED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 It shall be unlawful for any person, company or corporation to remove any tree or trees growing on the parking along and upon any street, avenue, or in any alley or on public grounds within the corporate limits of the City of Fort Collins, without first having procured a permit therefor from the Com- missioner of Public works as hereinafter provided, and provided further that the right is hereby reserved in the City Council to order the removal from any parking, alley or pubic grounds in said City any tree or trees when in its judgment the public health, safety and welfare of the city require it Section 2 Any person, company or corporation desiring to remove any tree or trees from the parking along or upon any street, or upon any alley or public ground in front of a lot or lots owned by the applicant, within the corporate limits of the City of Fort Collins, shall first make application therefor in writing to the Commissioner of Public Works, describing therein the location of the tree or trees sought to be removed, a description of the lot or lots, with the block number, in front of which said trees are located, and which said lots are owned by the applicant, the kind of tree or trees to be removed and the reason therefor, which said application shall be duly signed by the owner of the lot or lots, or his or its duly authorized agent, If said application shall t be approved by the Commissioner of Public Works a permit shall be issued by him to the applicant upon a printed form prescribed for said purpose, upon the express condition that the applicant will save the City of Fort Collins harmless on account of any damages that may be caused or result to said city or any person arising out of any negligence in the removal of such tree or trees, and that the applicant will cause the stump and roots to be removed and restore the parking, alley or public ground to its former condition as it existed prior to such removal, and upon the further condition that the right is reserved to the City of Fort Collins to set or cause to be set in such parking, alley or public grounds, trees, to be designated as to kind, and furnished by it in place of said trees so removed, and in compliance with the terms and provisima of Ordinance No 10, 1914 Relating to Sidewalks and Parking Section 3 If such application should be disapproved and refused by the Commissioner of Works, the applicant shall have the right of appeal to the City Council, and the City Council shall hear and determine all matters in connection with said application after due notice to all parties concerned, and its determinatL&on shall be final and binding respecting said application Section 4 Any person company or corporation who shall violate any of the provisions of this ordinance shall, upon con- viction thereof, be fined in any sum not less than five Dollars ($5) nor more than fifty dollars ($50), and costs of proceeding Sec 5 All ordinances or pasts of ordinances in conflict with this ordinance are hereby repealed, but any cause or causes of action which may have accrued in favor of the City of Fort Collins prior -2- to the taking effect of this ordinance shall be prosecuted to the same effect as if no repeal had been made Introduced, read first time and ordered published at a regular meeting of the City Council held on the 30th day of April, A D 1917 Passed and adopted this 210� day of May, A D 1917 Commissioner of Safety and Ex Offibcio Mayor ATTEST (Lay1 /4vl, City Clerz l STATE OF COLORADO, ) as COUNTY OF LARIMER ) I, Ray Baxter, City Clerk of the City of Fort Collins do hereby certify and declare that the foregoing ordinance consisting of five (5) sections duly proposed and read at length at a meeting of the City Council held on the 30th day of April, A D 1917, was duly ordered by Aye and Nay vote to be published in the Fort Collins Courier, a daily newspaper of the City of Fort Collins in accordance with the provisions of Section 7 of Article IV of the City Charter, that thereafter, and on-to-wit, the 1/-/),�day of May, A D 1917, at a regular meeting of the City Council, said ordinance came before said Council on its final passage, a period of more than ten days having elapsed since the pbblication as set forth and that said ordinance, was upon second reading adopted as an ordinance, and thereafter and on, to-wit, the day of May, 1917, said Ordinance No as finally passed and adopted was duly published in the Fort Collins Courier a daily newspaper published in the City of Fort Collins Colorado IN WITNESS WHEREOF, I have hereunto set my hand this ;
