HomeMy WebLinkAbout017 - 12/20/1919 - RELATING TO THE ASSESSMENT OF THE COST OF CONSTRUCTION OF STORM SEWER IN STORM SEWER DISTRICT NO. 5, ORDINANCE NO 1919, BEING AN EMERGENCY ORDINANCE, RELATING TO THE ASSESSMENT OF THE COST OF CONSTRUCTION OF STORM SEWER IN STORM SEVER DISTRICT NO 5, SUB-DISTRICT NO. 1, AND PROVIDING FOR THE COLLECTION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1. That under and by virtue of the pro- visions of Ordinance No. 12, 1919, relating to the creation of Storm Sewer District No. 5, Sub-District No. 1, approved on the 2 0c day of A D 1919s Storm Sewer District No. 5, and Su -District No 1 therein were duly created, and provision made in said ordinance for the construction of a storm sewer in said district , and particularly in Sub-District No 1, and the said improvements provided to be constructed in said Storm Sewer Sub-District No. 1 have been duly constructed under contract as provided by law, and the said improvements have been duly accepted by the City of Fort Collins as therein provided, that thereafter the City Engineer of said City duly reported to the City Council the total cost of the construc- tion of the said storm sewer, including the cost of inspection, collection and other incidentals, and also including interest to the 1st day of March, 1920, when by the laws of the State of Colorado the first installment of the general taxes is due and payable, and which said sum amounts to Eleven Thousand Seven Hundred Seventy-one and 71/100 Dollars ($11,771 71) , that in and by said report the City Engineer apportioned upon all the real estate in said Storm Sewer Sub-District No. 1, in said Storm Sewer District No. 5 , in proportion as the area of each piece of real estate in said district improved is to the area of all the real estate in the district , exclusive of public highways in accordance with the provisions of Sec- tion 5 76 of the Revised Statutes for 1908, and in accor- dance with said apportionment , the cost is 00 01067 per square foot , which finding and report of the City Engineer is in accordance with the report heretofore made by the said City Engineer in respect to the assessments to each lot in said district Section 2 That at a regular meeting of the City Council held on the day of A D 1919, said report of the City Engineer concerning the assessment for said improvement in Storm Sewer District No 5, Sub-District No 1, was by resolution of the City Council duly accepted for the purpose of the consideration and deter- mination at a meeting of the City Council to be held pur- suant to a notice of the City Clerk as provided by law, that in and by said resolution the City Clerk was thereby instruc- ted and directed to publish notice in the Fort Collins Courier, the official newspaper of the City of Fort Collins, for a period of twenty (20) days, addressed to the owners of property to be assessed in Storm Sewer District No 53 Sub- District No 1 , stating the whole cost of the improvement, and the share apportioned to each lot or tract of land in said district and notifying the owners thereof that any complaints or objections that may be made in writing by them to the City Clerk and filed in the office of the City Clerk within thirty (30) days from the publication of the said notice, will be heard and determined by the City Council at -2- a meeting thereof to be held on the 20th day of December, 1919, at the hour of one o' clock P M of said day, in the council chamber of the city hall in said City of Fort Collins, that after said hearing the said City Council will take up the matter of the passage of an ordinance assessing the cost of said improvement, that pursuant to the authority contained in said resolution the City Clerk has caused to be duly pub- lished said notice in the Fort Collins Courier, the official newspaper of the City of Fort Collins, for a period of twenty (20) days, as provided by law, and that due proof of said pub- lication has been duly filed in the office of the City Clerk, that more than thirty (30) days have elapsed since the publi- cation of the said now, and Su ►�'���. vW� Section 3 That the total cost of the improve- ment in said Storm Sewer Sub-District No. 1, in said Storm Sewer District No 5, under and by virtue of Ordinance No 12, 1919 of said City, including the cost of inspeczion, collection and interest to the 1st day of March, 1920, amounting to $11,771 71, is hereby assessed upon all the real estate in said district in accordance with the provisions of Sections 5375 and 5376 of the Revised Statutes of Colorado for 1908, and that the proportion of the said costs assessed to each lot or tract of land in said Storm Sewer Sub-District No 1, in said Storm Sewer District No 5, shall be as follows, towit -3- STORM SEWER DISTRICT NO. 5-SUB-DISTRICT NO. 1 Lot Property Owner BLOCK 114 N 34 It 6 Reuben R. Rortltn6•••.•.•-••••.t_""""'.-- Section 4 All assessments therein provided for shall be due and payable within thirty (30) days without demand, provided all such assessments may at the election of the owner of the property assessed be paid in two annual in- stallments, payable March 1st , 1920 and March let, 1921s with interest on the unpaid principal payable annually at six per cent per annum Section 5 Failure to pay the whole of the assessment within the period of thirty (30) days shall be con- clusively considered and held an election on the part of all persons interested, whether under disability or otherwise, to pay in such installments Section 6 Failure to pay any installment , whether of principal or interest, when due, shall cause the whole of the unpaid principal to become due and payable immed- iately and the whole amount of the unpaid principal and accrued interest shall thereafter draw interest at the rate of one per cent per month, or fraction of a month until the day of sale as hereinafter provided, but at any time prior to the day of sale the owner may pay the amount of all unpaid installments, with interest at one per cent per month or fraction of a month, and all penalties accrued, and shall thereupon be restored to the right to pay the installments in the same manner as if default has not been suffered The owner of any property not in default as to any installments or payments may at any time pay the whole of the unpaid princi- pal, with the interest accrued, to the maturity of the next installment of interest and principal -4- Section 7 Payments may be made to the City Treasurer at any time within thirty (30) days of the passage of this ordinance, and an allowance of five per cent discount shall be made on all payments made during such period only Section 8 In case of default of the payment of any installment of the principal and interest when due, any and all property concerning which such default is suffered shall be advertised by the County Treasurer and sold for the payment of the whole of unpaid assessments thereon, at the same time or times, and in the same manner, under all the same conditions and penalties, and with the same effects as are proviaed by law for sales of real estate in default of the payment of general taxes Section 9 It shall be the duty of the City Clerk to prepare the foregoing assessment roll in said Storm Sewer Sub-District No 1, in Storm Sewer District No 5 , in proper form, showing in suitable columns each piece of real estate assessed, the total amount of the assessment , the amount of each installment of principal and interest , and the date of principal and interest , and the date when each install- ment will become due, with suitable columns for use in case of payment of the whole amount or of any installment or penalty, and deliver the same to the City Treasurer, and thereafter payments may be made to the City Treasurer at any time within thirty (30) days after the passage and taking effect of this assessing ordinance Upon the expiration of the thirty (30) days, the City Treasurer shall return to the City Clerk the assessment roll showing all payments made thereon, with the date of each payment , and thereupon the City Clerk shallpre- pare a permanent local assessment roll in book form, showing -5- in suitable columns each piece of real estate or property upon which the assessment is unpaid, the whole amount of the assessment unpaid, the date to which the same was computed, and the amount of each installment of principal and interest , and the date when the same will become due, with suitable columns for use in case of the payment of any installments or penalties Said roll shall be certified by the City Clerk under the seal of the City and by him delivered to the County Treasurer of Larimer County with his warrant for the collection of the same Section 10 All collections made by the County Treasurer on said assessment roll in any calendar month shall be accounted for and paid over to the City Treasurer on or before the tenth day of the next succeeding calendar month, with separate statements for all such collections for each month Section 11 The owner of any divided or un- divided interest may pay his share of any assessment upon producing evidence of the extent of his interest satisfactory to the officers having the roll in charge Section 12 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this ordinance shall take effect upon its passage and publication, under and by virtue of the autho- rity contained in Sections 6 and 7 of Article IV of the City Charter y Introduced, read at length and adopted by the unanimous vote of all the members of the City Council this members of the Council, as an emergency ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, and thereafter, on towit the �-9 0*day of December , 1919s
