HomeMy WebLinkAbout028 - 12/03/1921 - RELATING TO THE AMENDMENT OF SECTION 1 OF ORDINANCE NO.023, 1921, PROVIDING FOR THE ORGANIZATION OF y ORDINAiCE NO. 0?8 1921 , BEING AN EMERGENCY ORDINANCE RELATIiuG TO THE AMEXDVIEWT OF SECTION 1 OF ORDINANCE NO. 22, PASSED AND ADOPTED OCTOBER 1, 1921, PROVIDING FOR THE ORGANIZATIOiv OF SANI- TARY SEWER DISTRICT NO. 35. WHEREAS, On the 1st day of October, 1921, the City Council auly passed and adopted Ordinance No. 22, providing for the organization of Sanitary Sewer District No. 35, fixing the boundaries thereof, authorizing the con- struction of sewers therein and providing for the issuance of bonds to pay for the cost of construction thereof; and WHEREAS, Since the adoption of said ordinance, the owners of certain property have petitioned the City Council to have the same incorporated in said district for the pur- pose of assessment and to that end have petitioned the City Council to pass an ordinance amending Section 1 of said Ordi- nance ivo. 22, and incorporating this property of petitioners in said district for all purposes; therefore BE IT ORDAINLD BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That Section 1 of Ordinance No. 22, 1921, be amended so as to read as follows: "Section 1. That pursuant to tine terms and pro- visions of Ordinance No. 7, 1921s being an ordinance relating to local public improvements, there be &ad nercuy is created and organized Sanitary Sewer District No. 35, consisting of Blocks 1 and 2, Swett ' s Adaition, and Blocks 1 and 2, VanSlyke- Setzler Addition to the City of Fort Collins, and a tract 154.5 feet in width facing on Mountain Avenue, and on the east side thereof 380. 5 feet and on the west side 382 feet in length, a nd Frances L. %urn6u/� owned byA, and a tract 100 feet in width facing on Mountain Avenue and 308.5 feet on the east side thereof and 310.5 feet on the west side thereof, owned by John Sartori, and one tract 50 x 16� feet , facing on fountain Avenue, owned bykc 'Thomrson, all in the City of Fort Collins, and that the work of construction of said im^rovements in said Sanitary Sewer District ;To. 35 consist of a main sewer line and branches as per map on file in the office of the City Engineer . " Section 2. In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this ordinance shall take effect upon its passage and publication under and by virtue of the autho- rit�f contained in Sections 8 and 7 of Article IV of the City Charter.
