AT ALL RAILROAD CROSSINGS ON STREETS PAVED WITH CONCRETE WITHIN THE CITY OF FORT COLLINS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That all railway companies or corporations now operating or that may hereafter operate their railways on any street within the limits of the City of Fort Collins across streets which are paved or which may hereafter be paved with concrete shall cause its track or tracks to be laid to the established grade at such street intersections and shall pave said track or tracks between the rails and for a distance of two feet on either side of the rails with concrete to the same width as the paving on said street adjoining said intersection, such pavement to be on a level with the top of the railway tracks Provided, however , that the City Council may permit the installation of other hard surfaced material in place of concrete paving, if in its judgment it deems the same sufficient and, satisfactory, and also provided that any plank crossings now installed at railway crossings on streets paved with concrete may, at the discretion of the City Council, remain in place until such time as the said City Council shall in writing order the same removed and concrete or other suitable crossings installed therein Section 2 Any such railway company or corporation violating any of the provisions of the foregoing sections shall forfeit and pay to the City for each offense a sum of Fifty ($50 oo) Dollars , and shall be subject to a like penalty for each day such violation eontinues after notice from the City Council, and the City Attorney of this city shall immediately prosecute the offending company or corporation to judgment and execution in any court of competent jur isdicti on -1- Section 3 In the opinion of the City Council an emergency exists for the preservation of the public health, peace and safety, and this ordinance shall take effect upon its passage and publication under ani by virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter Introduced, read at, length and adopted by the unanimous vote of all members of the City Council at a regular meeting held this �day of 05"e/D /e)" 6 e , A D 1928 —'—T `_�omm ss oner o s%0 y an ieio or ATTEST y Clerk STATE OF COLORADO j SS COUNTY OF LARIMER j I, A J ROSENOVI, City Clerk of the City of Fort Collins , do hereby certify and declare that the foregoing ordinance consisting of three (3) sections was duly proposed and read at lWgth at a re lar meeting of the City Council held on the � 9 dayof e to e , A D 1928, and was duly ad5p-ted and ordered published in the Fort Collins Express-Courier, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the City Council, as an emergency ordinance in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter gf the City of Fort Collins, and thereafter and on to-wit the .P_ N day of dc fo /, ei- , A D 1928, said Ordinance No ,3 o was duly publ is lied i i the Fort Collins Express- Courier, a dai newspaper published in: the City of Fort Collins , Colorado IN WITNESS 71HEREOF, I have hereunto set my hand and affixed the seal of said City this .2 �d day of pc c)b e ! , A D 1928 i y Clerk -2-
