HomeMy WebLinkAbout004 - 02/13/1926 - CALLING A SPECIAL ELECTION TO VOTE ON THE PROPOSITION AS TO WHETHER OR NOT A CHARTER CONVENTION SHAL ORDINANCE N0. 4 , 1926 BEING AN EMERGENCY ORDINANCE CALLING A SPCCIAL ELECTION TO VOTE ON THE PROPOSITION AS TO WH,,TH^R OR NOT A CHARTER CONVENTION SHALL BE CALLED TO ADOPT A NEW CHARTEP. FOR THu' CITY OF FORT COLLINS, COLORADO. VMREAS, A petition was on the 22nd day of January, A. D. 1926, filed with the City Clerk, which petition purported to contain the names of qualified alactors of the City of Fort Collins, Colorado, in number not less than ten per cant of the next preceding gubernatorial vote in said city; and % EREAS, Said petition has bean by the City Clark of the City of Fort Collins presented to the City Council of said city for its action thereon; and WfEREAS, Said petition, after investigation, is found to contain ten the names of qualified electors in number morn thar/per cent of the next preceding gubernatorial vote in said city; and WjMR3A.S, Said petition requests that a special election be called not lass than thirty days nor more than sixty days from the date of the filing of said petition to vote on the proposal for a charter convention; therefore BE IT ORDAINED BY TFh. CITY COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That a special election sha'I be called, as provided by law, and held in the several precincts and wards of the City of Fort Collins on �Tuesdag _ the 23rdday of March, A. D. 1926, at which election there shall b3 submitted to the qualified electors the question whether or not a ch-,rter convention shall be called under and pursuant to Sections 4, 5 and 6 of Article XX of the Constitution of the State of Colorado. Section 2. The said election shall be held at the following places in said precincts and wards in the City of Fort Collins, Colorado, to-wit: Precinct 1, Ward 1, City Hall; Precinct 1, Ward 2, Dodge Garage 2.18 VV Mountain_ Ave � Precinct 2, Ward 2, Laporte Avenu© School____ Precinct 1, VArd 3, Court House; Precinct 2, 'Ward 3, St John' s Evangelical Lutheran Church, ; corner Canyon Ave. and Mulberry St. -1- Precinct 3, Ward 3, Washington School ; Precinct 1, Ward 4, First Chr stian Church ; Precinct 2, rard 4, R ee ; hedb St. Chttrch Precinct 1, 7Ard 5, State Armory; Precinct 2, Ward 5, Lincoln School Section 3. The polls shall be opened at the hour of seven o' clock A. ^".. and shall remain open continuously and be closed at seven o'clock P. 14. of said day. Section 4. The said election shall be held and conducted, as nearly as may be, in the manner prescribed by law in the case of elections for municipal officers. Each elector offering to vote at said election must be a qualified elector, and must be registered under the provisions of Sections 7636 to 7670, both inclusive, of the Compiled Laws of the State of Colorado, 1921. Section 5. The City Clerk of the City of Fort Collins is hereby constituted supply clerk for said special a13etion, and he is hereby authorized and empowered to purchase and furnish stationery, ballots, ballot boxas, poll books and al: other supplies necessary for said special election. Section 6. Upon the passage and adoption of this ordinance the City Clark shall publish notice and call of said special election as hersin authorized, in accordance with Section 5 of Article XY. of the Constitat:on of the State of Colorado. Section 7. The ballots to be used at this election shall be uniform in size and color, and shall contain printed theraon in legible type, the following: "Shall a Charter Conv-ntion be called to Adopt a New Charter for the City of Fort Collins," followed by the words "Yes" and "No," which ballots shall be arranged substantially as follows: SHALL A CHARTER CONVENTTON BE CALLED TO ADOPT A AMW CHARTER FOR YES THG' CITY OF FORT COLLINS? NO Voters desiring to vota for the charter eonvanton shall mark a cross X in the blank space to the right and opposite the word "yes"; votars desiring to vote against the charter convant.on shall mark a cross X in the blank space to the right and opposite the word "no." Section 8. In the opinion of the City Council an emergency exists for the preservation of the public health, peace and s-faty and this ordinance shall take affsct upon its passage and ublication under and by virtu.a of the authority contained in Sections 6 and 7 of Article IV of the City Charter. D. 1926, and was duly adopted and ordered published in the Fort Collins Express_Couri>r, a daily newspaper and the official newspaper of the City of Fort Collins, by the unanimous vote of all members of the Coe,ncil, as an emergency ordinance, in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter; and thereafter, on to-wit: the 16th day of February A. D. 1925, said Ordinance No. 4 vas published in the Fort Collins Express- Courier, a daily newspaper published in the City of Fort Collins, Colorado.
