VACATING OF TJir ALLEY LOCATED IN THE SOUmT, HALF OP BLOCZ 280 OF LOOMS ADDITIOid TO THE CITE OP FORT COLLINS pU,"- NING NORTH AND SOUTH BETAEEN LOTS 22 Ai,D 23 I11 SPID BLOCK "HE+REAS, The City Council has been pe+i- tioned by Frank A Somerville, the owner of the south half of Block 280 , Looais Adaition to the Citj of Fort Collins, to have tune alley in said block running north and south between Lo' s 22 and 23 vacated, and WHEREAS It appears from saia petition, as hell as the records of said Cisy and the favorable report, from the CoAiissioner of '+orks, that said alle; has never been opened, accepted and used by the general public and is not a public necessity for the resiaents of said Block 280 and tnat the opening and maintenance of the same would involve continuea e.L-oense on behalf of the City aithou+ any resulting benefit to the pro- nerty holders in said block or the City at large, therefore BE IT ORDAIJED BY THE CITY COUTCIL OFT THE CITY OF FORT COLLI11S Section 1 That the alley located in the south half of Block 283 of Loomis Adaition to the Cit,A of Fort Collins being a s"rip of land trel+y (20) feet wiae and two hunared feet (200) long between Lots 22 and 23 in said bock, be and the save is hereby vacated and from trerce fortnx-it"i Tl e sa-a strip of Vera seal_ be treated as a part of said lots adjoining said tract ana all right title and interest Lnerein snall beco-ne vested in the said Frank A Somerville , the owne_ of Lots 22 and 23 , in said Block 280, as provided by law, provided that all expenses incurred by reason of the adoption passage and ,oublication of this ordinance shall be paid b said Soruervil VLL �.,r�—(tee--IOU � Sec+ion 2 In the opinion of the City ` Council an emf-rgency exists for the preservation of tre q -oublic healtn, peace and safety and t'iis ordinance shall take effect upon its passage and publication, under and ' in virtue of the authority contained in Sections 6 and 7 of Article IV of the City Charter i Introduced, read at length and adopted by the unanimous vote of all the meubers of the City Council t',is 2 day of April, A D 1920 �uL isslon��a et/ Ex Officlo layor ATTEST 411!?
