HomeMy WebLinkAbout001 - 04/12/1913 - PROVIDING FOR AND REGULATING PUBLIC SCALES, AND FOR THE OFFICE OF CITY WEIGHER r • r COPY ORDINANCE NO, 1, 1913 AN ORDINANCE PROVIDING FOR AND REGULATING PUBLIC SCALES, AND FOR THE OFFICE OF CITY WEIGHER. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS, Section 1. That upon the passage and adoption of this ordinance, there shall be established, provided and installed in the City of FortCollins public scales, and there is hereby created the office of City Weigher, who shall have supervision of and be in charge of the said scales. The said city weigher shall be appointed by the City Council of the said City to serve at the pleasure of the City Council , and shall receive such sal- ary for his services as the Council shall fix and determine. Section 2. . The City Weigher shall execute a good and sufficient bond unto the City of Fort Collins in the sum of $500, with sureties to be approved by the Mayor, conditioned for the full and faithful discharge and performance of the duties imposed upon him by the ordinances of the city. Section 3. Amended by Ordinance No. 2, 1914. Section 4, The City weigher shall be provided with a register and the said city weigher shall keep a record therein of the weights taken on said public scales by entering therein the amount of each load, part of a load or article weighed, the name of each person for whom, and the date when the same was weighed and when the vehicle and load, part of a load or other articles shall be weighed, together with the city weighers cer- tificate, which shall state the gross weight thereof, and upon the delivery or return of a wagon with part of load or other ve- hicle, the vehicle shall again be weighed without charge by the city weigher, who weighed the original load, part of a load or other article, and the amount thereof shall be shown upon said certificate by which the net weight may be ascertained and shall be entered thereon by said weigher. Section 5. In no case shall the city weigher state in . t his said certificate the weight of any vehicle which may have been weighed with any load until he has ascertained the weight of said vehicle be actually, personally weighing the same on said public scales, nor shall he issue any certificate of the weight of any such vehicle if the same was weighed upon other scales than the public scales when loaded or containing any ar- ticle or articles, whereby it is sought to obtain the net weight of the load or article or articles formerly in said vehicle, nor shall he place the weight o44ny vehicle upon any certificate other than the certificate upon which he has already designated the gross weight of said vehicle and the load, part of a load, or article or articles that it contained nor shall he deliver any certificate to any person, persons, corporation or firm using the said public scales, unless the certificate has been fully made out and completed by himself as to gross weight, tare and net weight. When a loaded or partly loaded vehicle is presented at the said public scales to be weighed, the said city weigher shall weigh the same, noting the gross weight of the vehicle and load or part of a load as aforesaid on his said certificate, and shall retain the said certificate until the empty vehicle or the vehicle with any remaining portion of the load shall be presented to be weighed at said scales, which weight when ascertained shall be placed upon the said certificate, which shall be the tare weight and the said certificate shall be completed by the said city weigher and the net weight be thereupon designated, and all re- quirements of this ordinance applying to the weighing of the emp- ty or partially loaded vehicle first, and then the loaded vehicle or additionally loaded vehicle next in order, shall be applicable to the latter method adopted as hereinabove set forth Section 69 The City Weigher shall turn over and deliver unto the City Co ncil of the said city all moneys received by him on Saturday of each week during the term of his office. -2- Section 7. That the said public scales shall be in- spected at the expense of the said city at such times as shall be deemed necessary for maintaining and providing for and main- taining accurate weights. Section 8. It shall be unlawful for any persons, per- sons, corporation or firma or any officers or members, agent or employees thereof, to fail or refuse when requested so to do by the purchase of any coal, hay and like articles of merchandise, of which any such person, persons, corporation or firm is or are the venders thereof, to refuse or fail to weigh such articles upon the said public scales of the City of Fort Collins before delivering the same to their customer, purchaser or venders thereof, and upon conviction therefore, they shall be fined in the sum of not less than $25.00 for each offence. Section 9. It shall be unlawful for any person, to al- ter any certificate of the said weigher, or use or attempt to use the same for any other load, part of a load or article than the one for which the same was given, and it shall be unlawful for any person after the sale and before the delivery of any load, part of a load or other article to diminish the quantity thereof, and upon conviction of any such offences, such person shall be fined in the sum of not less than $100,00 nor more than $300.00 for the offence. Section 10, Ordinances No. 13, of the Series of 1893, Amending Ordinance No. 2, of the Series of 1890 entitled "Re- lating to City d-eighers" , and all ordinances and parts of ordin- ances of said City in conflict herewith are hereby expressly repealed.
