HomeMy WebLinkAbout013 - 08/17/1914 - RELATING TO THE LICENSING OF AUCTIONEERS, PEDDLERS AND CANVASSERS i ORDINANCE NO. 1914 AN ORDINANCE IN RELATION TO THE LICENSING OF AUCTIONEERS, PEDDLERS AND CANVASSERS, AND REPEALING ORDINANCE NO 179 OF THE SERIES OF 1911, and ALL OTHER ORDINANCES AND PARTS OR ORDINANCES IN CONFLICT THEREWITH HE IT ORDBINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1. It shall be unlawful for any person to sell any property at public auction in the City of Fort Collins without first having obtained a license therefor as provided in this ordinance, sales made under and by virtue of legal processes or under and by virtue of any power contained in mortgages, trust deeds or similar instruments are hereby excepted from the provisions of this ordinance Section 2 It shall be unlawful for any person to sell or offer for sale , or in any manner assist in or about any sale or offer Of sale of any goods, wares or merchandise within the corporate limits of the City of Fort Collins by hawking or peddling the same , or to assist in any manner in the hawking or peddling thereof without first having obtained a license therefor as provided in this ordinance , but no license shall be required on any wagon or other vehicle, on the horses thereto attached or on the owner thereof, bringing to the city food products grown or raised by such person or persons so having them for sale , and are products of the State of Colorado. Section 3 An auctioneer' s license good for one day only shall be issued by the City Clerk to any one applying for the same, which license shall specify and designate the sort or kind of property to be auctioned, upon payment of the sum -1- r specified in this ordinance applicable thereto, which payment shall be made in advance An auctioneer' s license covering farm implements, wagons, buggies, harness and saddlery goods not comprising a merchant' s stock or any portion thereof, and covering livestock of any and all descriptions , or covering any or all of said articles or property, shall be one dollar ($1.00) a day. An auctioneer' s license covering secondhand household goods of any and all descriptions,not comprising a secondhand dealer' s or merchant' s stock, or any portion thereof, shall be one dollar ($1.00) a day All other auctioneer' s license or licenses shall be twenty-five dollars ($25.00) a day Any auctioneer' s license or licenses issued hereunder shall be valid only in the hands of the person to whom it is issued, and shall not be transferable Section 4. A license to hawk or peddle goods, wares and merchandise within the corporate limits of the City of Fort Collins shall be issued by the City Clerk upon the approval of the Commissioner of Safety to any person applying for the same upon the payment of the sum of twenty dollars ($20.00) per annum in advance Such license shall be valid only in the hands of the person to whom it is issued, and shall not be transferable Every person engaged in or about, or ibn any way assisting in the sale or offer of sale of goods, wares and merchandise by hawking or peddling, shall be required to take out a license , as herein provided, and the City Council shall a have the power to revoke such license at its pleasure Section 5 Any person who shall violate any of the provisions of tkis ordinance shall on conviction thereof be fined not less than twenty-five ($25 00) dollars nor more than one hundred dollars ($100.00) , and the costs of suit, and in -2- default in pa;, nt of such fine and costs such person shall be imprisoned in the city jail or other place provided for the incarceration of prisoners, until such fines and costs are paid, but not to exceed ninety (90) days, or such persons may be required to labor upon the streets or public buildings and grounds of the City of Fort Collins, one day for each two dollars ($2.00) of such fine and costs until the same are fully paid. Section 6 Ordinance No. 17 , 1911, being "An Ordinance in Relation to the Licensing of Auctioneers, Peddlers and Canvassers," approved November 20, 1911, and all other ordinances or parts of ordinances in conflict hbeewith,are hereby expressly repealed, but this repeal shall not be construed to affect any penalty or cause of action heretofore accrued in favor of the City of Fort Collins , but the same shall be treated as to penalties and causes of action as though said ordinance or ordinances had not been repealed Passed and adopted this Il t� day of August, 1914 Mayor ATTEST City CLERK I hereby certify that the foregoing is a true copy of an ordinance wh ch was introduced read and ordered published on August 3 � , 1914, an which was duly published one inser- tion i th�,J C � a daily newspaper, one the �,r,F, day o August, 1914, and which will come up for final consideration and passage by the Council at t regular meeting of the Council on Monday, the day of August, 1914.
