BY GRADIiJG AND SURFACING THE SANE AND PROVIDING FOR THE PAYhMNT OF THE COST OF SUCH IMPROVEMENT BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 'Rhenever the owners of a majority of the front- age of lots or lands adjacent to or abutting upon any street or alley or a designated portion thereof not less than one block shall petition the City Council in writing to grade or gravel or otherwise surface said street or alley or designated portion thereof not less than one block it shall be the duty of the City Council to order such improvement or-impravements to be made or cause the same to be made and assess the cost of said improvement against the lots or lands adjacent to or abutting upon said street or alley so improved and to collect the same as by law and herein provided Said improvement shall be ordered by resolution of the City Council and shall designate by name and number the improvements so ordered and provide therein that the cost of said improvement may be paid by the ovm ers of the lots or lands assessed in not to exceed J0 annuel payments with interest on the deferred payments at the rate of six per cent &tAn/%A- ' Section 2 If the said petition shall be for grading only or graveling only or for grading and graveling combined the improvements shall be r4ade by the city under the supervis_on of the Commissioner of Public Borks but before any street or alley f _ y shall be graveled or otherwise surfaced the grade thereof shall be established by the City Engineer and any street or alley graded shall in like manner have the grade thereof established and all improvements shall conform to said grades Section 3 Then any street or alley or portion thereof not less than one block shall be graded or graveled or graded and graveled or otherwise surfaced as herein provided pursuant to petition as aforesaid accurate account shall be kept by the Commissioner of Public Works of the entire cost including all \aterials used labor performed and engineering expense on account thereof the cost of publishing the notices and making assessments as herein provided After the work of construction shall have _ been completed the Commissioner of Public Works in conjunction with the City Engineer shall examine the same and if consttacted as ordered the said Commissioner of Public Worxs snall make a report to the City Council approving the same and reporting the total cost thereof the total frontage of the lots and lands subject to assessment the owners as near as may be ascertained and the amount of assessment per lineal foot to be assessed on all the adjacent or abutting lots or lands together with a recommenuation as to the portion if any of the entire expense which should be paid by the city out of its permanent street fund by reason of the improvements upon street intersections or special benefits to the public occasioned by such improvement Section 4 On the filing of said teport the City Council shall proceed to consider the same and fix the amount to be assessed per lineal foot against each lot and parcel of land fronting upon the street or alley or portion thereof so improved as well as the owners for the purpose of defraying the cost of said improvement the Council shall by resolution fig the date on which it will hear any and all objections concerning assessments -2- so made which objections shall be filed in writing and it shall be the duty of the City Clerk to give notice of said hearing to the owners of said lots and lands by publication once a week for two consecutive weeks prior to the date of said hearing in the official newspaper published in the City of Fort Collins which said notice shall state the date of said hearing the nature of the improvement and the amount of assessment per lineal foot on account thereof and the names of the ovmers of the respective lots and the amount assessed against each thereof At the date specified the Citv Council shall proceed to hear any objections or complaints which may have been filed in writing and may continue the hearing from time to time and upon the conclusion of said hearing shall by resolution justly and equitably adjust the cost of said impzovement and assess the =" same pro rats upon the abutting lots and lands and the owners thereof and the amount so assessed shall be a lien upon said lots and lands from the date of ordering said improvements until the same is fully paid Section 5 Nhen the said assessment is finally made and established as provided in Section 4 the City Clerk shall enter the same in his assessment book to be kept for that purpose in which suitable columns shall show the names of the owners if known the number of lineal feet frontage owned by each and the amount of assessment per lineal foot against each owner and the date of the assessment when paid and if certified to the County Treasurer when certified and collected together with any other proper data If the City Council has provided by resolution for more than one payment of said assess- ment then the first of said payments shall be payable v�ithin thirty days from the date when said assessment is fixed by the City Council and if said first nayrient is not made at the expiration of thirty days the City Clerk shall certify said .3- assessment together with other deferred payments to the treasurer of Larimer County who shall extend said assessment upon his tax roll and collect the same in the same manner as other taxes assessed upon said property Section 6 For the purpose of providing a fund against which warrants may be drawn in the first instance for the payment of all street improvements made under the provisions of this ordinance at the time of the granting of any petition for such improvements the City Council shall provide by resolution for } the creation of an improvement fund to be named according to the street and the number thereof and all expenditures made on account of the permanent improvement within said improvement dis- trict under the provisionsof tnis ordinance shall be auaited and warrants drawn in payment thereof against said fund which said warrants shall be redeemed as herein provided if tnere are no moneys in the hands of the City Treasurer with which to pay said warrants when presented the same shall be endorsed "h o Funds" ana shall draw interest fro the date o ULAAAAAAAWOUf f pre se tment ec�4__ at the rate of six per cent per ann.. which endorsement Wall be made upon the back of said warrant by the Citj Treasurer and all warrants so drawn shall have the name of the improvement district upon the face thereof and any interest accruing on said warrants before final payment shall constitute part of the costs and expense of said improvement and shall be so computed and charged by the Commissioner of Public Works in making his report to the City Council and all interest which shall accrue on said fund subsequent to the date of the assessment shall be to pay the cost of said improvement and to redeem all warrants issued on -a- account thereof together *ith interest th ervon at the rate of six per cent per annum Section 8 All ordinances or parts of
