HomeMy WebLinkAbout017 - 10/16/1916 - REGULATING THE USE AND OCCUPANCY OF STREETS AND CURBS WITHIN THE LIMITS OF THE PAVING DISTRICTS HERE e i� ORDINANCE NO: 1916 REGULATING TEL USE AND OCCUP,-.hCY OF STREETS AND CURBS WITT?IN THE LIbIITS OF THE PAVING DISTRICTS HERETOFORE ESTABLISHED AND PROVIDIITG PELALTILS FOR VIOLATION TnREOF BE IT ORDAINED BY TYE CITY COUNCIL OF THE CITi OF FORT COLLIYS Section 1 That all persons and corporations are hereby prohibited from erecting placing or maintaining in any street or t thin the limits of any pa.vin district heretofore OY established and dul paved a hitching post or hi thing rail coal box light poles telephone or telegraph poles or any other obstruction upon the street excepting therefrom the ornamental lighting poles erected for lighting the streets in said paving districts and the poles erected for the mainte- nance and operation of the Denver & Interurban Railway cars within said districts also the hitching of teams is hereby prohibited within the limits of said paving districts etc r° Section 2 That where any obstruction such as is pro- hibited by section 1 of this ordinance shall exist at the time of the taking effect of tnis ordinance it shall be the duty of the Commissioner of Public 17orks to notify in writing each and every person or corporation erecting placing or maintaining such obstruction to remove the same within t (J days after the receipt of said notice If after the expiration of said time such obstruction still remains said Commissioner of Works is hereby authorized and empowered to remove such obstruction by cutting or tearing the same down and causing the material to be dclivercd to the person or corporation awning the same Section 3 The notice provided for in Section 2 of this ordinance shall orly b,e necessary before the removal of an obstruction by the Commissioner of Public 7orks but s",all rest be necessary as the basis of prosecution and conviction under this ordinance Section 4 All persons and corporations are hereby pro' ib, *cd from permitting automobiles to stand upon the streets within the paving districts in front of ar„ place of business for any period of time exceeding 3� minutes and all persons desiring tomllow automobiles to remain upon the streets in said paving district shall nark the same upon the east side of the street railvray traick�art�yv�,,(� �g � G� C9d°) an angle of iv rues—(-4-5°) to the said track and- U distant therefrom e ` feet ax-,e� $ �C1 C-Y' Section 5 Every roerson o�ration who shall violate anj provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not less than , �' _ dollars nor more than dollars and costs of suit and may upon conviction be committed to the city jail until such fine and hosts are paid but not to exceed ninety (90) days Section 6 All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed ttroduced read fist time and ordered published this _-day of September A D 1916 (9C� Passed and adopted this day of SEptre�e 1916 Commissioner of Safety and ATTE Ex-0fficio .,ayor
