HomeMy WebLinkAbout020 - 07/23/1917 - RELATING TO THE VACATING OF A PORTION OF THE STREET ABUTTING UPON THE SOUTH SIDE OF LOT 1, IN BLOCK ORDINANCE NO 1917 �U RELATING TO THE VACATING A PORTION OF THE STREET ABUTTING UPON THE SOUTH SIDE OF LOT 1, IN BLOCK 141, IN THE CITY OF FORT COLLINS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That all that portion of the street lying south of and abut'-ing upon Lot one (1) in Block fourteen in the City of Fort Collins, Colorado, more particularly described as follows, to-wit Beginning at a point where the south line of Lot 1 in Baia Block 14 intersects the westerly line of Pine Street, thence west on a line being the prolonga- tion of the north line of Laporte Avenue 31 7 feet to a point whicr is on the east line of College Avenue, thence south along the east line of College Avenue 9 feet to a point, trcnce following a curved line to the point of beginning, said curved line to be located as follows Begin iing at a point on the e,.st line of College Avenue where the same is intersectea by the north line of Laporte Avenue produced thence e4st from the above rentioned point 6 S feet, thence south 14 feet to a point on tl e ckrme, thence from a point on the east line of College Avenue where the same is inter- sected by the north line of Laporte Avenue proauced thence east 14 feet to a point thence south 15 feet to a point on the curve thence fror a point on the east line of College Avenue where the same is inter- sected by the nortn line of Laporte Avenue producea, thence east 20 feet to a point, thence south 12 feet to a point on the curve, thence from a point on the east line of College Avenue where the same is inter- sected by the north line of Laporte Avenue proauced, thence east 25 feet to a point, thence south 7 6 feet to a point on the curve the above description locating four points on the curved line, be and the same is hereby vacated so as to enable the said owner of Lo} 1 in Block 14 in said city her heirs and assigns, to use and enjoy that vacated portion to the extent of twelve (12) feet in width thereof south of said south line of Lot 1 -1- in Block 14, fo,. the purpose of establishing and maintaining a filling station in connection with said Lot 1 in said Block 14, and the remaining portion of said vacated tract to be used jointly by the general public as well as the owner of said Lot 1 in Block 14 for access to said Lot 1 as well as to said filling station, Proviaed, that the owner of said Lot 1 in said Block 14, her heirs and assigns shall at her own expense at all times hereafter maintain the concrete paving constructed over said tract in good repair in accor- dance with the requirements of the City Council and the City EnEineer of the City of Fort Collins, and Provided, further, that the said owner of Lot 1 in said Block 14 shall upon the taking effect of this ordinance file with the City Clerk an acceptance in writing, duly acknowledged as requlsed by law, wherein and whereby the said owner shall unqualifiedly accept the terms and provisions of this ordinance Section 2 The right is hereby reserved to the City of Fort Collins and to its City Council to repeal this ordinance at any time it may be shown to the satisfaction of the City Council that the owner of said Lot 1 in Block 14 has failed and refused to observe the conditions of this grant after thirty (30) days' notice thereof in writing given by order of the (pity Council Introduced read and ordered printed this day of June A D 1917 Passed and adopted this day of July, A D 1917 Commissioner of Safetv and ATTEST Ex Officio Mayor City Clerk STATE OF COLORADO, ) -as COUNTY OF LARIMER ) I, Ray Baxter, City Clerk of the City of Fort Collins, do hereby certify and declare that the f oregohng ordinance consisting of Two (2) sections was duly proposed ana read at length at a meeting of the City Council held on the it' day of June, A D 1917, and was duly ordered by aye and nay vote to be published once in full in The Fort Collins Courier, a daily newspaper of the City of Fort Collins, in accor- dance with the provisions of Section 7 of Article IV of the City Charter, that thereafter and on, to-wit, the day of July A D 1917, at a regular meeting of the City Council, said ordinance came before said Council upon its final passage, a period of more than ten days having elapsed since its publication as above set forth, and that said ordinance was upon second reading auly adopted as an ordinance and duly numbered and thereafter ana on to-wit, the aay of July 1917, said Ordinance No as finally passed and adopted was duly published in The Fort Collins Courier, a daily newspaper published in said City of Fort Collins, Colorado Iid WITNESS WHERQEOF, I have hereunto set my hand this day of .Iu.
