HomeMy WebLinkAbout022 - 10/22/1917 - RELATING TO FIREMEN'S PENSIONS, AND ACCEPTING AND ADOPRTING THE PROVISIONS OF CHAPTER 75 SESSION LAW 4F1 ORDIi1ANCE NO r L - 917 RELATING TO FIREMEN'S PENSIONS, AND ACCEPTING AND ADOPTING THE PROVISIONS OF CHAPTER 75 SESSION LAWS OF 1917, PASSED BY THE 21ST GENERAL ASSEMBLY OF THE STATE OF COLORADO AND APPROVED APRIL 20, 1917, AND PROVIDIJG FOR THE CREATION AND ORGANIZATION OF A BOARD OF TRUSTEES UNDER SAID ACT FOR THE CITY OF FORT COLLINS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS Section 1 That complete acceptance, ratification and adoption is hereby made by the City of Fort Collins of a certain Act of the Twenty-first General Assembly of the State of Colorado and described as Chapter 75 of the Session Laws of 1917, entitled "AN ACT to Create and Establish Firemen's Pension Funds for Members of Regularly Organized Volunteer Fire Departments, Regularly Organized Paid Fire Depart- ments, and Regularly Organized Fire Department Aid Associations, their Wifes, Dependent Mothers and Dependent Children, and to Create Boards of Trustees of each of said Funds in the Municipalities in the State of Colorado, and to Provide for the Collection and Distribution of the Same and for the Maintenance, Management and Conduct of said Fund " Section 2 That pursuant to the provisions of said Act a Board of Trustees is hereby created, to be known as the Board of Trustees of the Firemen' s Pension Fund, and to consist of the following officers The Commissioner of Safety and Ex-Officio Mayor, the Commissioner of Finance and Ex-Officio City Treasurer, and the City Clerk, together with one member of the duly organized fire department of the City of Fort Collins, who shall be elected by the members of said fire department and his election duly certified to the City Clerk -1- Arr Section 3 It is further certified and declared that the City of Fort Collins is a municipal corporation of the second class, organized under a special charter under the Twentieth Amendment to the Constitution of Colorado, and that said city has a duly organized paid fire department, and has in serviceable condition for fire duty fire apparatus and equipment belonging to said city of the value of more than Five Thousand Dollars ($5,000 ) Section 4 Immediately upon the taking effect of this ordinance it shall be the duty of the Board of Trustees of said Firemen's Pension Fund to meet and organize by electing from their number a president and treasurer, and the Commissioner of Finance and Ex-Officio City Treasurer shall be Ex-Officio Treasurer of said Board and custodian of the funds provided for in said Act of the General Assembly Section 5 That under the provisions of said Act of the General Assembly, the said Board of Trustees is charged with the duty of manqgng and administering the fund which may come under their control for the payment of pensions to firemen and their dependents Section 6 It shall be the duty of the board immediately after organization to adopt all necessary rules and regulations for managing and discharging its duties, not inconsistent with the provisions of said Act, and said board shall hear and decide all applications for relief or pensions, and its action on such applications shall be final and oonclusive,except that when in its opinion justice demands that said action be reconsidered the same may be reversed by said board, and a record of said action and all other matters coming properly before said board shall be kept and preserved -a- 4JF I Section 7 After the organization of said Board of Trustees and the adoption of by-laxs and regulations as herein provided, it shall be the duty of said board to certify to the City Council of the City of Fort Collins the names of the officers of the board as organized, and a copy of the rules and regulations adopted for managing and discharging its duties Introduced, read and ordered published this �-WA4-� day of A D 1917 Passed and adopted this Z day of 60cl 2s 1917 Commissioner of Safety and Ex-Officio Mayor ATTESL��1 City Clerk 4F1 STATE OF COLORADO ) -es COUNTY OF LARIMER ) I Ray Baxter, City Clerk of the City of Fort Collins, do hereby certify and declare that the foregoing ordinance, con- sisting of seven (7) sections, was duly introduced and read at length at a regular meeting of the City Council held on the :7�6 day of September, A D 1917, and was duly passed and adopted by an Aye and Nay vote of all the members of the City Council at said regular meeting, and oddered published in the Fort Collins Courier, a daily newspaper of the City of Fort Collins, in adcordance with the providions of Section 7, of Article IV of the City Charter, and that thereafter and on the ZL,:�Lday of A D 1917, sadd Ordinance No as passed and adopted was duly published in the Fort Collins Courier, a daily newspaper published in said City of Fort Collins, Colorado In Witness Whereof, I have hereunto sey my hand this day of �r� n� A D 1917 City Clerk
