BEING All EMERGENCY ORDINANCE RELATING TO THE CALLING OF A SPECIAL ELECTIONT FOR THE PURPOSE OF SUBMITTING TO THE QUAL- IFIED ELECTORS OF THE CITY OF FORT COLLINS THE QUESTION THETHER THE CITY OF FORT COLLINS SHALL ACQUIRE BY PURCHASE THE PROPERTY OF THE DENVER & INTERURBAN RAILROAD COMPANY IN THE CITY OF FORT COLLINS TOGETHER 'F=H THE LINE OF SAID RAILROAD EXTENDING TO LINDENMEIER LAKE AND ALSO FOR THE PUR- POSE OF SUBMITTING AT TEE SAME ELECTION THE QUESTION NETHER THE CITY OF FORT COLLINS SHALL BE AUTHORIZED TO INCUR AN INDEBTEDNESS BY THE ISSUANCE OF BONDS IN THE SUM OF $$100,000 TO PAY FOR SAID RAILWAY PROPERTY AND TO EQUIP AYD OPERATE SAID STREET RAIL'7AY AS A MUNICIPAL RAILWAY. THEREAS, Pursuant to the provisions of Section 21 of Article XVIII of the City Charter, the City Council by a resolution duly adopted on the 6th day of November, 1918, duly authorized and directed the Commissioner of Safety and Ex-Officio Mayor to make an investigation and shall ascer- tain whether the City of Fort Collins should acquire the street railway property, or any part thereof, of The Denver & Intarurban Railroad Company in the City of Fort Collins, or connected therewith for the benefit of the inhabitants of said City; and WHEREAS, The said officer has duly made a report re- specting said proposed purchase and has recommended that the ,uestion of making said purchase be duly submitted at a special election to be called for the purpose of obtaining a vote of the qualified electors of said City upon said question sad also recommended the submitting of the question of incurring a bonded indebtedness in the sum of $100,000.00 to provide funds Faith which to make such purchase, which said report was on the 23rd day of November, 1918, duly adopted by the City Council and ordered published once in two daily papers as provided in the City Charter; and -1- • w WHEREAS, A petition has been duly filed with the City Clerk and presented to the City Council subscribed by qual- ified electors of the City equal in number to at' least twenty-five (25) per centum of the last preceeding vote, to- wit, November 5, 1916, cast in the City for Governor of the State of Colorado, requesting that the question whether or not the City of Fort Collins shall acquire by purchase the railway property of The Denver & Interurban Railroad Company in the City of Fort Collins or connected therewith for the sum of Seventy-five Thousand Dollars ($75,000.00) shall be submitted to a vote of the people and also requesting that there be submitted to the qualified electors at said special election the question of incurring a bonded indebtedness in the sum of One Hundred Thousand Dollars ($100,000.00) for the purpose of paying for said railway property and equipping the same; and WHEREAS, The City Council has duly caused to be canvassed and checked the signatures to said petition and finds that and the same has been duly signed by Six Hundred/Seventy-aeven (677) qualified electors of said City, the same being more than twenty-five (25) per centum of all the votes east in the City for Governor of the State of Colorado at the general election held November 5, 1918, which total vote as certified by the County Clerk of Larimer County was Two Thousand Three Hundred and Seventy-eight (2,378) . THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS, COLORADO. Section 1. That the Commissioner of Safety and Ex- Officio Mayor and the City Clerk are hereby authorized and directed to call a special election of the qualified, eleo- tors of the City of Fort Collins pursuant to the authority -2- contained in Section 21 of Article %VIII of the City Charter, which said City .election shall be called to be held in all the wards and voting precincts of said City on the 7th day of January, 1919, to be called as provided by law for the purpose of submitting the following questions to be voted upon by the qualified electors of said City: 1 . Shall the City of Fort Collins acquire by purchase the street railway property of The Denver & Interurban Rail- road Company in the City of Fort Collins or connected there- with for the sum of Seventy-five Thousand Dollare (w75,000.00)? ?Which questimn shall be submitted in the following form upon the ballot: Shall the City of Fort Collins acquire by purchase the railway property of The Denver & Interurban : YES Railroad Company in the City of Fort : Collins or connected therewith for the purpose of operating said rail- : NO road for the benefit of the inhabit- : ; ants of the City of Fort Collins? 2. Shall the City of Fort Collins incur a bonded in- debtedness in the sum of One Hundred Thousand Dollars ( 100,000.00) for the purpose of paying for the railway property of The Denver & Interurban Railroad Company in the City of Fort Collins or connected therewith to be op- erated by the City of Fort Collins? Which question shall be submitted in the following form upon the ballot: Shall the City of Fort Collins ; • • • • • . • • • • • • incur a bonded indebtedness in the sum of One Hundred Thousand Dollars YES : ($100.000.00) for the purpose of paying for the railway property of : . . . . .: . . . . . : The Denver & Interurban Railroad Company in the City of Fort Collins or connected therewith to be operated: NO by the City of Fart Collins? : . . . . . : . . . . : : . Section 2. That said special election shall be held in the following precincts and wards in said City at the follow- ing places, to-wit : -3- Precinct 1, Ward 1, City Hall, " 1, It 2, Lumber Office, 200 Block West Mountain Avenue, " 2, to 2, St. Paul 's Chapel, Shields Street, " 1, It 3, Court House, " 20 " 3, Chapel, Corner Canon Ave. and Mulberry Street, " 3, " 3, Christian Chapel, corner Oak and Mack Streets, " 1, " 4, Christian Church, corner College Avenue and Magnolia Street, " 2, " 4, Advent Church, Whedbee and Magnolia Streets, " 1, " 5, Baptist Chapel, Peterson Street. And the City Council is hereby authorized and directed to appoint the necessary judges and clerks for each of said precincts and wards as required by lair and the City Charter to conduct said election in said precincts and wards. Section 3. The polls shall be open at the hour of seven o'clock A. M. and shall be open continuously during the day of the election and shall close at seven o' clock P . M. of said day . Section 4. The election shall be held and conducted as provided by the laws of the State of Colorado and the City Charter as in the case of the election for City officers; each elector offering to vote at add election upon Question No. 1, when submitted, shall be a qualified elector under the constitution and laws of the State of Colorado and the provisions of the City Charter, and the ballot upon ad d Question No. 1 shall be deposited in a separate ballot-box provided for that purpose; every elector offering to vote upon Question No. 2 respecting a bonded indebtedness at said election, shall, in addition to the qualifications required to vote on Question No. 1 herein, have paid a property tax within the City of Fort Collins in the year next proceeding said election, and the ballots on said question shall be de- posited in a separate ballot-box provided for that purpose. -4- Section 5. Immediately after the canvas of the returns from said election, the judges t erein shall sign and return separate certificates of the votes case in the several pre- cincts and wards of said City, which shall be duly returned and filed in the office of the City Clerk as provided by law and the City Charter. Section S. The City Clerk of the City of Fort Collins is hereby authorized and directed to provide the necessary ballots, registration lists, poll books and all blanks re- quired for the proper conduct of said election and shall do and perform all other duties required by the laws of Colorado and the City Charter in a general election of City officers so far as the same are applicable in the conduct of this special election.. Section 7 . At the first regular meeting of the City Council held after the said election, the City Council shall proceed to canvas the certificates of votes cast at said election by the several precincts and wards in said City and enter upon its journal of proceedings a declaration of the results of the election upon both questions submitted. Section S. By reason of the fact that the proposal of The Denver & Interurban Railroad Company, thru its Re- ceiver, to sell its railway property to the City of Fort Collins, provides that the determination to purchase said property shall be ascertained as soon as the legal proceed- ings will permit, an emergency is hereby declared to exist for the preservation of the public health, peace and safe- ty; and, therefore, pursuant to the authority contained in Section 5 of Article IV of the City Charter and Section 9 of Chapter 97 of the Session Laws of 1913, this ordinance -5- shall take effect and be in force upon its adoption and publication in the official newspaper under the provisions of Section 7 of Article IV of the City Charter. Rosenow, City Clerk of the City of Fort Collins, do hereby certify and declare that the foregoing ordinance consisting of eight (8) sections was duly pro- posed and read at length at a meeting of the City Council held on the 37th day of November, A. D. 1918 and was duly adopted and ordered published in The Fort Collins Express, a daily newspaper, by the unanimous vote of all the members of the Council as an emergency ordinance in accordance with the provisions of Sections 6 and 7 of Article IV of the ,3 0. City Charter; and thereafter an onto-wit, the 3ftb day of Saab-er , A. D. 1918, said Ordinance No. 11 was duly pub- lished in The Fort Collins Express, a daily newspaper pub- lished in the City of Fort Collins, Colorado.
