HomeMy WebLinkAbout002 - 02/09/1929 - ADOPTING FOR THE CITY THE PROVISIONS OF CHAPTER 237 OF THE LAWS PASSED AT THE TWENTY-THIRD SESSION O Y • a ORDINANCE NO 2 , 1929, AN ORDINANCE ADOPTING FOR THE CITY OF FORT COLLINS, COLORADO, THE PRO- VISIONS OF CHAPTER 237 OF THE LAWS PASSED AT THE TWENTY-THIRD SESSION OF THE GENERAL ASSEMBLY OF THE STATE OF COLORADO, ENTITLED "AN ACT TO ENABLE CITIES AND TOWNS TO REFUND THEIR BONDED INDEBTEDNESS, " APPROVED MARCH 16, 19219 AND TO REPEAL ORDINANCE NO 2, 1916 WHEREAS, The City of Fort Collins, Larimer County, Colorado, has certain outstanding bonds which it desires to refund under the laws of the State of Colorado, and the charter of said city, and WHEREAS, Section 18 of Article 19 of the charter of Fort Collins provides that Sections numbered 6687 and 6694, inclusive, of the Revised Statutes of Colorado, 1908, relating to refunding bonds, are made and declared to be in full force and effect in the city until otherwise provided by ordinance, and WHEREAS, Sections numbered 6687 and 6694, inclusive, of the Revised Statutes of Colorado, 1908, have been repealed and in lieu thereof there has been enacted Chapter 237 of the laws passed at the twenty-third session of the General Assembly of the State of Colorado, which act was approved March 16, 1921, and WHEREAS, The City Council deems it advisable to refund the outstanding bonds of the city in accordance with the provi- sions of said Chapter 237 NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Fort Collins 1 That the provisions of Chapter 237 of the laws passed at the twenty-third session of the General Assembly of the State of Colorado, entitled, "An Act to enable cities and towns to refund their bonded indebtedness, " approved March 16, 1921, be and they are hereby made and declared to be in full force and effect in the City of Fort Collins 2 That as provided by said Chapter 237, no ordinance providing for the issue of refunding bonds shall be subject to the referendum provisions of any law 3 That in order for the city to take advantage of the present high bond market, an emergency exists and this ordinance is declared to be one for the preservation of the public health, peace and safety, shall be passed finally on the date of its introduction and shall take effect immedi- ately upon publication ADOPTED AND APPROVED this 9th day of February, A D 1929 Conimissioner of Saf ty Id Ma or ATTEST City Clerk STATE OF COLORADO ) SS COUNTY OF LARIMER ) I, A J ROSENOW, City Clerk of the City of Fort Collins, do hereby certify and declare that the foregoing ordinance was duly proposed and read at length at a regular meeting of the City Council held on the 9th day of February, A D 1929, and was duly adopted and ordered published in the Fort Collins Express- Courier, a daily newspaper and the official newspaper of the City of Fort Collins by the unanimous vote of all the members of the City Council, as an emergency ordinance in accordance with the provisions of Sections 6 and 7 of Article IV of the City Charter, of the City of Fort Collins, and thereafter and on towit the llth day of February, A D 1929, said Ordinance No 2 was duly published in the Fort Collins Express-Courier, a daily newspaper published in the City of Fort Collins, Colorado IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said City, this llth day of February, A D 1929 VQ"t"O.�� City Clerk
