BEING AN EI:IERGENCY ORDINANCE RELATING TO THE VACATION OF AN
IRREGULAR TRACT LOCATED AT THE INTERSECTION OF EAST MOUNTAIN AVENUE,
LINCOLN AVENUE tiND JEFFERSON STREET, ABUTTING ON LOT 1 OF BLOCK 11,
IN THE CITY OF FORT COLLINS.
WHEREAS, The City Council has been petitioned by Clara
M. Brose, the owner of Lot 1, Block 11, of : he City of Fort Collins,
upon which lot the irregular tract hereinafter described abutts, .
to have the irregular tract at the Southeast corner of Block 11,
inside of property lines and property lines extended of East Mountain
Avenue, Lincoln Avenue and Jefferson Street, vacated; and
WHEREAS, It appears that said irregular tract has never
been used by the general public for street or other purposes, and
is separated by the curbs and gutters as now located from the used
protions of said streets, and that the holding of such irregular tract
by the City would involve payment of assessments by the City for any
special improvements that may be assessed against the same without
any resulting benefit to the City at large; and said petition having
been granted, upon payment to the City for special improvements
heretofore made and assessed against said tract; therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That portion of the street area, as shown
by the plats of the City of Fort Collins, Colorado, lying East of
and abutting upon Lot 1 in Block 11, in the City of Fort Collins,
Colorado, more particularly described as follows, to-wit:
Commencing at. the Southeast corner of Lot 1,
Block 11, City of Fort Collins, Colorado,
thence East along the North property line of
East R4ountain Avenue 26 .20 feet, more or less,
to the intersection of said line with the
Northwest property line extended of Lincoln
Avenue; thence North 410101 East along the
said Northwest property line extended of
Lincoln Avenue 13.99 feet, Mora or less, to
the intersection of said extended property
line with the Southeast property line of
Jefferson Street; thence North 48050' Vilest
along the Southeast property line of Jefferson
Street 46 .88 feet, more or less, to the North-
east corner of said Lot 1 in said Block 11;
thence South 41.4 feet , more or less, along
the East line of said Lot 1 to point of
beginning,

incurred by reason of the adoption, passage and publication of
this ordinance, ana all special improvement taxes assessed against
saia i.Lzegular tract be raid, and also that all special improvement
taxes hereafter assessed be pain without abatement or allowance
upon accourt of the irregular snape of said tract of said Lot 1
of Block 11 on which said tract abutts
Section 2 In the opinion of the City Council an
emergency exists for the preservation of the public healtn, peace
and safety, and this ordinance shall taro effect upon its passage
and oublication under ana by virtue of the authority containea
in Sections 6 ana 7 of Article IV of the City Cnarter
Introduced, read at length and adopted by zhe unanimous
vote of all the members of the City Council this 27th day of September,
